Sorry if this is a repeat, I just don't have time to exhaustively search forums, so I'd like to tap into the bored, public database of knowledge....

I seem to remember that when I filed my wife's I-485 back in 2007 that the time window to file the eventual I-751 was 180 days (6 months) before expiration of the GC.

But now I read it is 90 days (3 months)? Whatever, memory is fading in my early 30s....

The importance of THIS however, is that I'm not really optimistic a decision will be rendered within 3 months, even though it SHOULD basically be a formality.

So are a boatload of people walking around with expired temporary GCs while they wait for their I-751s to be approved? Or is there some kind of travel/waiver form like with the I-485 that you can submit - and SHOULD submit - so you can leave or get back into the country while you are waiting for the USCIS decision?

It is 90 days, as clearly on the I-751 instructions.

Also, there's no travel waiver. When you file the I-751 you receive a NOA which extends the expired GC for one year. Employment and travel is authorized.

I filed I 751 late, it was 3 days before my GC expire ,then i received letter for one year extention. I went to my country and back to US after 3 months. My GC was approved 3 weeks ago after 13 months in VCS.

You can file 90 days before the expiration date on your GC. I would mail it on the 89th day before that date. I don't know how USCIS counts their days. Do not mail it early because you could get a RFE and slow down your process. Good luck on your journey.

Read the Guides above and read this forum. Search what others have done and make notes. Start preparing your papers now. Download the forms at the USCIS website. Fill them in now so you will know whether or not you have any questions. Before you file, check the forms again on USCIS. Sometimes they update them and will return your packet for out dated forms.

So I guess having the NOA letter allows you free travel and employment.?

Stupid system. It doesn't change that if you need to travel and get back into the country with an expired GC, you have to explain to the border guy with a "note" from USCIS why you're okay. That's shady.

You guys have been in those lines, the USCIS guy I went through last time didn't even know if he was supposed to be procesing "LPRs" (legalized permanent residents) in his line or not.

I'm sure it will be fine though.....probably :)

That is only a limitation to file the proper forms , no need to worry the first adjustment of status is in 90 days after you arrive , then when the two years is over on your conditional residence you have 6 months up to that time to adjust your status again to get green card . You have nothing too worry about as long as you didnt past the 90 days to file adjustment of status , or the 6 months to adjust status again to get green card . ( as long as you filed the adjustment of status before your legal status expires , you are still good too go ).

Do folks usually bring the *original* NOA1 (extending conditional GC up to 1 year) with them or a copy?
