hi there everyone,

pls i need advise--

i arrived u.s. jan 28, after a week of stay here, i gave birth to a premature baby, we needed to stay at the hospital for almost a month (the baby's ok now) as soon as we reached home, we get my ssn then get married. now the problem is, we can't file for an aos yet cos my hubby's laid off from work just like anybody else... too bad, i know we should file for an aos as soon as possible, but for now we don't have means to do that, and our baby's health is more important to me for now. now my question is, after marriage, to we have to inform the uscis or whoever that we are already married, and how long i am possibly allowed to stay here in the u.s. before filing an aos?

Go to My Assistant above and update your Timeline. We can't answer your questions without information. If you are in the US, you should get married within 90 days of your arrival. You can wait for AOS for a year or two. I would not recommend it, but there is no requirement you have to file right after getting married. You just won't have a Green Card and cannot travel until you get one.

Congratulations on your new baby. Glad the baby is doing good. :thumbs:

Good luck on your husband finding a job.

By the way, if you do not get married within 90 days of your arrival, you will have to go back home.

You should at least get your Social Security card.

You can get a co-sponsor for support when filing for the AOS.

as long as you got married within the 90 day window you will be fine.

thanks guys for the replies, i think i gave u a vague infos. i arrived in u.s. jan 28 (k1) and then after a week of stay here, gave birth to a premie kid, then stayed at the hospital (other state) for almost a month, then as soon as we got home from the hospital, we applied for my ssn then get married march 13th. ,,,hope that's clearer.

You could always apply for a waiver of fee's from filing. (I would think having a pre-mature child, and husband losing job would qualify you)

Waiver

I would not feel safe putting off the AOS pass your I-94 expiration. You will be out of status, and there are cases here on the forum where people are in trouble by getting stopped by ICE at checkpoints, even though they had a marriage license.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
