Hi all..Just want to share myexperience with you. Despite the other info from others on 'you can file your AOS later (K1visa holders) as long as you marry within 90 days from your arrival time' , we filed our AOS before my I-94 expired. For the last month alone, I had been through the checking points by border patrols(Arizona and Texas) and the Indiana highway patrol. They were not happy with my expired I-94 and still raised their eye brows with our marriage certificate. I handed over all my AOS paperwork (NOA1 and Biometric appointment), we were strandedon the roadsides for almost 3hours while they were waiting for my 'legal status' from the supervisor and the immmigration office. Have your AOS/EAD filed, bring your USCIS NOAs anywhere with you, and get to know your alien number. Summer is coming and the police will be everywhere. You may be safe by staying at home....but who want to stay at home whole summer?

GC approved without the interview after 6 months and few weeks. The case status online is still with the last touch on November 2008. Don't open that website too often..:-)

Yeah one lady filed after the I-94 expired and got busted in Texas. She is going thru removal proceedings. She'll no doubt beat it buts it's costing her $4,000 for a lawyer. Main problem can occur if you are anywhere near the border. Even can happen boarding a plane anywhere. TSA hits up peeps now and then flying local.

thanks for the info. im paranoid something will happen like that to alfredo. we already sent the AOS paperwork in and his I-94 doesnt expire officially until the 19th i believe of this month, but im hoping that i can get a NOA before that date and we can get this stuff rolling. thank god we dont live in arizona or any border states because i would be making sure he had copies of everything every time he left the house. tlk about crazy... that would be me. :blink:

March 12, 2009 AOS paperwork arrives in Chicago

March 23, 2009 NOA1 for I-485, I-131, I-765

March 30, 2009-Biometrics letter received, appt date April 10th @11am philly office

April 10, 2009-Biometrics appt. done, in and out in 15 minutes

Nov. 18, 2009-Card production ordered

I can't believe they're checking for your documents within the US! I suppose these are regular checkpoints in the southwest? Amazing.

So sorry you're having to go through this. Good information about keeping those papers with you!!

They usually do in the known "illegal" gateways/highways. You would be surprised on how many they actually catch.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
