Hello folks, i am back after a while to post our present situation here..

My fiance filed for I129F in September 2008 and got her NOA1 during the first week of October 2008.

Now after 5 months we receive a email on March 02, 2009 from the USCIS Requesting for more Evidence, the last time i met her in USA was in the month of June'2008.

I visited her again this February 2009 for Valentines and stayed with her for a period of 10 days, this time around we did not take any pictures together but i do have my Immigration stamp on my passport and Air Tickets.

Do you guys think this would serve the purpose of evidence.

Is USCIS asking for RFE's a bad thing or should we both be happy that atleast they are looking into our case and its not lying there unnoticed.My fiance also mentioned to me that the email spoke about I797 form.

What have you guys sent as RFE in your case..

P.S - The email that i received did not have attachments of any sort but my Fiance did, she is the petitioner so i am assuming that she would get the actual package with instructions in it.

11/19/07: Realized we were in love

02/22/08: Her next trip to India

04/18/08: She left India

05/30/08: My first trip to US

06/09/08: Left for India

02/12/09: Visited her again for Valentines

05/27/09: Mailed application to Vermont Service Center

06/01/09: Received NOA1

07/09/09: Visited her again in US

09/13/09: Received NOA2

09/22/09: Beth received letter from National Visa Center saying package was received and will be forwarded to Chennai within the week

09/25/09: Received email from Chennai with all the docs and interview date of October 29, 2009.

10/29/09: Interview in Chennai. Visa APPROVED!!!

12/10/09: Arrived at DFW, 5 min at the POE & i am in, apparently the officer who interviewed got his wife to USA on K1 visa,what an irony

02/14/10: Wedding at Southfork Ranch in Dallas Texas

02/14/10: Headed for a honeymoon in Las Vegas :)

02/17/10: Back from honeymoon

02/22/10: Started thinking about AOS,EAD,AP (its too much paper work)

03/06/10: Filed the AOS,EAD,AP application

03/26/10: Received NOA for AOS,EAD,AP

04/05/10: Received NOA I-797C for AOS (Case transfered to CA CSC)

04/28/10: Received NOA I-797C for Bio-metrics appointment

05/18/10: Bio-Metrics taken at the Fort Worth ASC

05/20/10: Received my AP document :)

06/03/10: Received my EAD Card and a "Welcome Letter" stating my Permanent Resident Card will be mailed soon... :)

06/17/10: Received my Permanent Resident Card (Green Card) :)

The I-797 is the form number of the communication form, it is called a Notice of Action (NOA) form. The "action" is an RFE which is not good. This would have been the approval if there was not missing evidence.

The I-129f requires you present evidence of meeting in person, at least one time, within two years of the submission of the petition. Your visit in June, prior to the filing in September will meet that qualification. It does not matter where you meet. BUT you need to provide primary evidence this meeting occured. Maybe she did not? You cannot just say, "we met in June 2008" and you cannot just send photos. Photos prove you met, but do not prove you met within two years (time stamps can be altered easily) Usually the petitioner provides 1 or more photos and evidence of travel, in this case YOUR boarding passes and YOUR visas or passport stamps to enter the US, plus any other evidence from that trip you ay have. Any evidence of visits AFTER the petition is filed will be used for the interview. They WILL NOT be considered for the petition, so don't bother sending anything about your February visit.

Copies of travel itineraries are not primary evidence. Copies of plane tickets are not primary evidence. Boarding passes and passport stamps are primary evidence, photos are secondary evidence and are useless without other support.

If you submit your passport stamps as evidence you MUST submit copies of ALL pages of YOUR passport, icluding the front and back cover. When they say "all", they mean exactly ALL. That means blank pages, empty pages...ALL.

Review what you sent and see if it meets the rules in the instructions. You clearly meet the standard, you just have to prove it, should be easy enough.

When you say "front and back cover" do you mean the inside cover or the outside cover as well? I only sent in a copy of the inside cover. I didn't think the outside cover would matter. I hope that's the case.

I copied from "United States of America" on the front outisde cover to the solid navy blue back cover. I presume when they say all, they mean...

Will you get an RFE? I don't know. If I am told there is a knife fight up the street...I bring a gun.

Oh, my fiance received her package, it seems she has to submitt her Divorce papers that has been approved by the courthouse, she had submitted her notarized copy of Divorce papers earlier..

Shall keep you all posted on our progress, the RFE does not look that bad after all...sign of relief :)

I am unaware of having to submit copies of all pages of the passport if one intends to use it as evidence of having met in the past two years. I am aware that one is to submit copies of all pages of the passport if one intends to use it as evidence of US Citizenship (Pettitioner). I did not submit all pages, rather just the photo and bio pages along with pages that contained the appropriate stamps.

An Request for Evidence (RFE) is generally not a bad thing except that it could delay the approval process while you gather and submit paperwork back to USCIS. (Unless you don't have the information that they request - that would be bad!) But on the whole, it's merely a need for a document that's been signed in triplicate, sent in, sent back, queries, lost, found, subjected to public inquiry, lost again, and finally buried in soft peat for three months (years in USCIS' case) and recycled as firelighters.

Latest update, USCIS wanted my fiance to submit her "Agreed Final Decree of Divorce" containing the date of Legal termination and Signature of Civil Authority, luckily she has the document and would be sending it to the USCIS...

So once sent should we consider or assume that this would be the final document and our case will be approved....

No. It is not safe to assume anything, however it would make sense they have reviewed your case and have requested what they need.

You can assume that some time (time period unknown) after they receive the requested document the will review your case again and send another notice, hopefully an approval

I submitted my I-129 last November without any boarding passes or plane tickets (did not keep any of those since I did not know then I was going to marry this woman).

All I did was printing out from my airline web site my list of trips to my fiancee's country. With some pictures copied on a 8x11 page.(without any date on them) and copies of my passport.

I sent the same list from my fiancee's airline. This was accepted as evidence we met.

Now my petition is at the embassy, so my evidence were accepted as is.
