I found some info on the VSC page:

about expediting cases. It's near the middle of the page under "General expedite procedures by mail", under this is another link which gives more details about how a case may qualify to be expedited:

One of the criteira listed as reason for expediting is "USCIS error". Has anyone else considered this info, and are there any ideas out there about this process? There was clearly a mistake or error made in this process but I'm not sure which agency made the error in this situation. In any case, I look forward to some good thoughts on this.

Yes I started a post on this a day or 2 ago. VSC is clearly in error on the petitions that were approved in error, then recalled. I'm going to create a draft letter and place it in my post, get comments if any and then send it out with my RFE.

I have been under this same impression, that USCIS made an error, and we deserve expedited service. The emotional rollercoaster that all of us have gone thru due to USCIS error cannot be replaced any other way. I am just wondering what we can include as evidence. How about this:

Well, because of this huge delay I am in the process of making a suprise trip to see my love!!!!

03-15-06 - NOA1

08-28-06 - Interview!!!

11-22-06 - Got the Visa!!!

02-08-07 - I-485 sent

02-14-07 - NOA1 (Sent to Missouri)

03-06-07 - Biometrics Appointment

03-07-07 - Transferred to CSC

05-03-07 - Card Production Ordered Email

05-10-07 - Green Card In Hand

03-05-09 - I-751 sent

03-09-09 - NOA1 (1 yr Extension)

Mike, yeah, that memo would definitely be included along with a copy of your I-797C, notices from the NVC and consulate also. And a letter obviously explaining the situation and why you think you deserve the expedite. (USCIS error)

SO why should we wait to send them, if they are going to two separate people? I am thinking about sending in the Expedite Request now, and the RFE when I get it. Maybe that will even expedite the RFE.

That's exactly what I was thinking. Anyway what is the point in sending in the request when you already have the RFE? According to the procedures on the above sites, the envelope has to be mailed to a particular address and be marked with "EXPEDITE REQUEST". If you attempt to expedite, the whole point is you want it done asap.

I'm going to work on this today, it's too hot out anyway!

That's cool you're going on a trip, I'm going to visit my love next week!

I faxed an expedite request to Vermont a week ago and received a nice form letter from Paul Novak denying my request and stating that the petition will be processed within the normal time. I am one of the recalls from Moscow one week before the scheduled interview.

But try anyway Maybe one of us will succeed!

I'm not sure that the IMBRA would be considerd as an error on the part of the uscis.

Thats just the way life is guy's and there isnt much we can do about it.

The fact of the matter is who is to blame ? can you place blame, even though they should have forseen the problems with the forms before hand?

I dont see where any one agency is to blame here.

Its clearly an govt. oversite that was really unavoidable.

If you think about it how can they impliment something like this all in a short period of time without someone being affected?

I think if alot of the people stop sending so many e-mails and calling for nonimportant reasons maybe they can get something done there .

I see people wanting to call and send e-mails and they only been in the process for 2 weeks.

Really what are they thinking of when they think that they will get some results in 2 weeks?

I dont like waiting as much as the next guy but i am not going to flood the service centers with a bunch of junk so i can slow down the process even more.

Each time people send letters ,call,send e-mails it takes manpower to do that and it just clutters up the system,i dont see how it can help unless you really have a valid complaint.

They most likely will be processed in the order of the dates your petitions were received, so expediting (even if it were permitted) wouldnt change anything. You will still be processed before later petitions....IMHO.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I doubt that the people who process the packages are sitting their with personal phones taking calls. I really doubt it's interrupting anything. I haven't called a service center, and I don't plan to for quite some time (see timeline) but seriously. It's 100% gov't's fault and they should be working OT to do this. They screwed up and if a few people call them on it, who knows, perhaps their approvals will be expedited. I see no problem with people standing up for themselves.

After I read this, I was kind of amazed at the sit back and wait attitude of these statements. These attitudes are exactly how and why the USCIS has become the untransparent, inefficient behemoth it is today. To imply that people trying to communicate with their government is a negative thing which slows down governmental efficiency is nonsense and to say that this was unavoidable is also nonsense. I agree, there is a possibility there is not one agency to blame, but in my opinion it was clearly USCIS error which means I have a right to request an expedite as you do according to their policy. I'm sure a lot of the other members don't consider their correspondence with their representatives, senators and governmental agencies "junk" as you do. I hope the process goes quickly also, but I refuse to just sit and wait.
