Regarding EAD For K1 Visa Holder

My fiancé has been granted a K1 Visa and is due to arrive in the US in a week or so. As he is keen to find work as soon as possible, we are looking for ways to go about this. My understanding is that he is unable to find permanent work until he gets his SSN, which I think is applied for after we are married (I may be reading that wrong).

I can vaguely remember reading somewhere that he can ask for a 90 day EAD at his Port of Entry. Has anyone either experienced this or has knowledge of it? I have read through the FAQ and Guides and am still not sure of the correct way to try to do this.

Any help is appreciated, thanks! :)

10 Oct 05 - Fill out K1 Visa & send to Texas SC

26 Oct - My ring is bought and we are officially engaged!

28 Oct - NOA1 received

10 Jan 06 - I fly to UK to meet Stephen's family and visit for 3 months

11 Jan - USCIS requests "additional information" from us

25 Feb - RFE packet mailed out to California SC

06 Mar - California SC receives packet

22 Mar - NOA2 - Approved!

20 Apr - Stephen receives his packet from the Embassy!

22 Apr - Stephen mails packet 3 back to Embassy!

09 May - Medical appointment booked for 1 June. Checklist mailed same day.

19 May - Embassy replies with Packet 4 - INTERVIEW 2nd of JUNE! :D

01 Jun - Stephen flies to London for medical that day and interview next day

02 Jun - Approved at Embassy! Once medical results are in, Visa will be on its way!

11 Jun - Stephen receives Visa!

22 Jun - Stephen flies to US!

I think most people say 3-6 months until you can work. Not many POEs give temp EAD and if you get one many employers are not into hiring someone who can only work for 90 days. You usually won't get the EAD before the temp expires.

*January 24 2006 - mailed in I129-F petition

*January 25 2006 - I129-F received at CSC

*January 30 2006 - packet returned.....arggggggggg we forgot one signature!!

*January 31 2006 - sent I129-F back to the CSC, hope we did not forget anything else

*February 1 2006 - I129-F received at CSC again

*February 3 2006 - NOA1

*April 20 2006 - NOA2!!!!!

*April 24 2006 - Touched!

*May 15 2006 - NVC received petition today!

*May 17 2006 - Case left NVC today!!

*May 30 2006 - Received Packet 3 from Vancouver!

*May 30 2006 - Faxed back Packet 3!!

*June 6 2006 - Received packet 4!

*June 20 2006 - Medical in Saskatoon

*January 2007 - RFE for kids Greencard.

*February 2007 - kids medical and sent in RFE

*February 2007 - Received kids greencards

If he gets a Temp EAD at POE it is good for 90 days.... he will need to apply for a SSN and that will take 2 -4 weeks to get.... if he then finds a job and starts work and you have got married and filed for AOS and EAD the chances are that his Temp EAD will have run out and he will have to give up work and wait for the 1 year ead to be approvel and received before he can start again looking for work....

At the moment 1 year EAD is taking 90+ days to get.... and in some cases people have got their interview date before they have the EAD.....

As far as I know, the only POE that still offers the temp EAD stamp is JFK airport...

It will be difficult to find permanent work on the temp EAD, since there will almost always be that gap in authorization between the expiration of the I-94 and the approval of the EAD. But if finances are a major concern, there should be a good two months from the time your fiance gets his SSN and before his I-94 expires.

This is so true. As a small business owner I have hired many people and, until my experience with the fiancee visa process, I had never even heard of an EAD. As long as the person I hired had a SSN I was happy. I have never even asked to see a SS card. Legal or not, I am sure he can get and keep work. Just be smart.

And yes, he CAN apply for SSN b4 marriage... Just wait at least 2 weeks after he gets here to his name get in the system, therefore it will take a long time to the SSN to be issued...

I think you need to go and read the rules about EAD... yes there are employers who will employ you without checking your status but they are breaking the law.... all employers are required to complete a I-9 for any employee whether they be USC or not.... and yes you are required to stop work when your Temp 90 day EAD ends.... it can not be renewed as your status is no longer K1 by that time.... you have to apply for a new EAD along with or after you have applied for AOS.... Thank you for telling me to get informed...... I think it is you who needs to get informed.....

If the OP deceides to break the law and work without EAD then that is there choice..... But I will not tell anyone here to do something that may have an effect on the outcome of their AOS....

Please take time to check out the law regarding working within the US.... a SSN is not enough you need the EAD as well....

Thats correct. You are required by federal law to check the persons ability to legally work. A SS# does not give you permission to work.

Maybe some other people on here need to "check their facts" before posting wrong info... :whistle:

Regarding driving licence, base on my experience, they just asked for my SSN, photo ID, birth certificate and prove of residence. So I think you don't need to show them EAD or Greencard as long as you can provide them that (there's a list of documents you need to show them and you just need 3 of them actually). I haven't applied for my driving license since I'm waiting for my EAD with my marriage name, change the name on SSN (it's in my maiden name), then I'll try to submit for one.

I try to change my name on SSN after I got married but the guy there asked me to change my status on my passport to K3 (I came with K1 visa) which I thought it's odd so I just wait for my EAD to arrive and try to change my name on SSN card again later.

Well all I know is that here in MA they will not issue you with a drivers licence unless you can prove that you are a resident and allowed to remain in the US... if you apply using your passport with a K1 visa they will only give you a licence that is valid for the same period as your I-94 after that you need a EAD or Greencard to get it extended....

I do know that diffrent States have diffrent rules some will accept the AOS NOA1 as proof of status....
