I think I'm going to appeal. Whenever I get the NOID I will inform u guys what's the reason for denial. Thanks you for all your advice. I'm going through I tough time right now. I been crying from Thursday. I just hope I get through this.

Crying won't solve or change your situation. Thinking about next step and working towards it will. Calm down get yourself together and think about what you have submitted , ask people for advise or suggestion, gether evidences and prepare yourself. be strong.

May 26th, 2009 : WAVA filed.

June 1st, 2009 : RFE issued Good moral: replied june 15th 2009

July,17 2009 : Prima facie approvel received.renewed again march 3, 2010

February 2, 2010 :I-765 filed, : denied

August 12,2010 :RFE issued on WAVA, more evidence needed.

sept 3rd 2010 : I-765 filed again. 9/15/2010:Filing receipt received.

Sept 15,2010 : REF answered with all evidences.9/17/2010:RFE recvd by USCIS.

Sept 19, 2010 : I 765 approved.

Sept 19,2010 : I360 touched. status changed to RFE Under review.

sept 20th 2010 : I 765 card production ordered, No Biometric, no picture etc.

sept 21 2010 : I 765 touched, still card in production.

Sept 22,2010 : I-765 touched, Card in production.

Sept 23, 2010 : I765, touched, Approval letter mailed. Card approved (???)

Sept 24,2010 : I 765 touched again. No change???

Sept 27, 2010 : EAD received.

october 3, 2010 : old expired EAD from last year touched (#######?)

OCt 20,1020 : I 360 approved.letter received.

oct 25 2010 : I 360 touched.

april 20 2011 : court date. I,m my own lawyer.I expedited my date: filed I 485, new date January 9th 2011, case terminated.

may 9th 2011 : I 485 interview.

MAy 25th 2011 : Card production ordered.

99 % of appeal cases denied .on 2009 ,the website of administratice show 400 cases of I-360 appeal ,Just 3 was approved .i read one by one .

but its not final now front of you the best advise that no one will tell you ,i take decision not to write but i have to tel you now my heart still bleeding .

first thing you do you should not go for appeal i advise you deeply .you can appeal if you argue that the officer not folow the strategie of process and not give give you apportunity of INTEND TO DENY befor deny the case and the AAO Will forward the case again to the director to use the intend to deny but even they send you intend to deny just waste of time can take to 4 or 3 years trust me no chance for approval .the appeal take 3 years more .but you should not go for appeal to AAO .now you have Two ways .the first one go for Motion to reopen with VSC .or File new petition i-360 must be good documented with no errors .

about good faith mariage now most case at AAO denied the Appeal after 3 years .remember the appeal is hard .because the officer folow the process of your case and most time the AAO agree with the service .only if there is errors by law you should argue ,the argument should be egainst the oficer deny your case .but the arguments should be respectful like you gona apply for job .they can deny the case just for wrong word or any mean .like i said 400 case just 3 cases approved .for sure i am not waste my time and yours we are victims of all this events and we should give advise and not more pain .god willing you gona resolve this issue .

1-FILE motion to reopen befor 30 days be careful ,1 day late they deny the case .with new and lots of evidences with VSC only take 3 month

2-file new i-360 befor you gona be in removal proceeding after 30 days End .

about the new evidences that not in your hands now .

you can find everything jointly with ur spouse online print the documents .also try to remember if you go with your spouse to library or store receipt or dentist .or restaurant receipts or car indurance jointly cal the insurance they will find out and send you copie .cal the dentist they will give you record .even u dont have anything now .i thik you have but you dont check good and remember what you hve .

you can go to the online comunication with your spouse befor and after mariage .to find out your chat .

the letters or receipt of i485 and i-130 or withdrow letter that was filed by your spouse on your behalf and his affidavit of support is Strong Evidence .Good luck . you need new and lots eveidence if you appeal AAO laways need to see more evidence not 1 or 2 . they folow the law and there is Great People working honest if you are eligible they will approve you .they are great people like i said .

it aint about how hard you hit .its about how hard you can get hit and how much you can take and keep moving forward even broken

Kwala is right about this one. Appealing Immigration cases is almost a sure loss. People rarely, ever win the appeals, and they take 3-5 years onwards.

When I was in this process, my guidance director always told me this: If they deny, we wait for the period allowed and start a new application.

The thing with appealing is that you now have real judges and attorneys looking at you case. And man, they are trained to kill it. Even if they had not given a NOID, they will not approve. Even if they find that IO who denied you was wrong, they will also find another ground the IO did not see initially.

I do not know anyone who won an appeal. Remember you will still pay the attorney anyway.

If I were you, I'd consider re applying. May God give you strength.

I got the denial letter. Its says I didn't have enough evidence to prove me and my husband lived together. My lawyer thinks I should refile the case with letters from witnesses who knew we lived together. Thank you Kwala and MulanJohns and all the others who gave me opinions on what to do. For some strange reason, my I485 is not denied.

Yes I agree with everything and I think you should re-apply for the vawa with more solid evidence from people who know you. This time try to get all the letters notarized and if possible get a copy of their ID as well and send it in..

This is what I did...

On top of things I contacted my lawyer to see if there is anything that could be done about this anonymous phone call I got from this special agent, and he started yelling at me saying he is a man and I should not discuss deep things with him...?? Thats what this whole VAWA was about... "Sexual abuse and physical and emotional abuse"

This is ridiculous... I guess all men are the same when it comes down to it.. :crying:

Lawyers only care about making money. So the best one can do is be strong, optimistic, and self-reliant. Just ignore his comment. No matter what happens, the worst is over and it will only get better. Wish you all the best.

Now its hard to reaply new one again or file an appeal to AAO administrative of appeal .Currently You Dont Need Any Attorneys or Layers .Its done lawyers and attorneys try when the case stil brand new .if you folow the motion to reopen by your self trust me vsc will approve you because many members been in the same situation ask pascal and i start with two attorneys then finish by my self ..by your self now the attorney will folow the same things and will not be able to convaince the office because the offficer want hear from you ,you are the victim .

Listen Keep Folow the Same case like i do .because your first case is good u just need to satisfy the officer with more evidences for Residence with your spouse .

Folow The denial of your case .File Motion to reopen i-290 b with the same office deny your case .the denial notice is not final ,the officer stil needs more evidences .go head and file motion to reopen with VSC . and send statments from anyone you know landlord ,the person who rent for you and your spouse ,the neibers any one i mean anyone .even anyone ,i mean u been here and you met people .I file an appeal with 37 new evidences and finaly after 51 months Got Cal at 7 am .folow the motion to reopen and if it is denied you can apply new i-360 or file an appeal to AAO i-290 B

Motion to reopen needs .

1-i-290 b form with fee Waiver ,

2-New letter Dated and Notarezed of more than 8 pages just keep talking about ur residence since you move with ur spouse .

3-letters from friends who knows you live with your spouse and they see both of you going and out of the house or appartement .Minimum 8 .do the best ask everyone who knows you .

4-additional new evidences ,anything .relax home and think what you touch by ur hands or do since the first smile with your spouse .update your memory you gona find if you said no i will not beleive you .

if you send those things you gona be approved .even you send 1,2,3 or Even Just Send the motion to reopen form and A letter tel them that you are eligible by law .Try Motion to reopen because the officer will review all the case Again and approve it if he is not approved it He Should get recommendation from the director Then the director will make decision after review it again and enter a new Favorable decision on his OWn its the appeals Law trust me .My Hair become White on the appeal Process ,because most offices they dont want review anycase .Good Luck . wish u still have time .officers work on appeals they are Great people they look at the things carefuly they do understand the law more .they do look at every word on the case if you are eligible they will approve you right away .they folow the law right way .i said appeals officers

It's almost Christmas again. I wish you all a very Merry Christmas/Happy Holidays & a very Happy New Year!

And I also want to know if it's posible to go back to school with a prima facie? I have no work permit yet, and I was hoping I could keep myself busy somewhat by going back to school, that way, I might be able to take my mind of this VAWA case.

I hope that all is well with you.. I was doing a masters degree and I was paying international tuition before, the after my husband filed an I130 for me and an I485 I showed them the paperwork and they gave me instate tuition. I think u should try to show the admissions office those documents and they might grant you instate tuition..

Just a really dumb question, how do you guys know that your application was "touched"?

Very simple, go to www.uscis.gov, then click on the icon that says"sign up for case updates", after that a new window will open, there click on "register as an applicant customer", read all the blah blah blah and press "accept", then start filling up your infos. I hope that help good luck to you.
