Hello, i need this answered urgently please. I've gotten K -1 visa through a laywer and paid him 1k, now when i called to do AOS, he's asking 3k more. So i wanna do it myself as i barely have enough $ to pay the 1k fee's.

I didn't fill out tax return for for 2005, 6, 7, but did for 2008 with 12k/year income. So i don't have any tax returns to put in with my I-864. Im waiting for my W-2.

My wifes I-94 expires in 12 days and i need to know if im going to be ok if I apply for AOS later in a month or 2 when i get my W-2. ( i do have a co sponsor)

please tell me the best way to go about this. Lawyer told me that if i got married within 90 days then wife can stay here legaly in the country for as long as whe wants because she's a wife of a citizen and was married within the specified time of 90 days, but i read here that you have to apply for AOS right away so that you don't have any problems. Is there any one out there who has applied after 90 days for AOS and had problems ? or is it ok for me to fill it out later? Thank you very much and god bless you all!

LOTS of people apply after the 90 days. There is no time requirement to file for AOS. Just have to marry in the 90 days.

AOS is pretty easy. No need a lawyer. Just follow the guides and post for any questions you have. WOW 3K?

Most folks here will/are/have done AOS without the use of an attorney - for most, it is a fairly strait forward process. Unless you have circumstances beyond the 'norm' (such as overstays, etc) you would likely be OK to follow the DIY path (again, unless you have circumstances you haven't mentioned).

I think there are as many folks who file for AOS after the 90-day/I-94 expires as do before - you do want to do so as quickly as possible so your spouse's legal status is protected and he/she can enjoy the benefits of being a Permanent Resident (i.e., driving, working, etc).

As far as your taxes go - only the most recent year is required (unless more would help your case).

You'll be fine waiting. I've heard of people waiting 2 years. The reason people do it quickly is to get the work authorization asap so the new spouse can work. They won't reject AOS or deport her if you don't file by the end of the 90 days. I think getting your taxes done first is a good move.

You can file AOS later but 12k a year isn't enough income to qualify as sponsor. You'll need a qualified joint sponsor.

1. Get your money back from your lawyer if you can. Still cannot fathom why anyone hires a lawyer for this.

2. How did you do 2008 taxes without a w-2? Or did you mean 2007? Law requires your employer to postmark w-2s to you by January 31, you should have it today or tomorrow. 12K is not enough, you will need a co-sponsor unless you have changed employment recently and can verify it.

3. You do not need 3 years tax returns for the I-864. Have you looked at it? You need to attach 1 year tax return and give a statement of earnings for the previous two years.

4. You are supposed to file the AOS within 90 days but nothing terrible happens if you do not, however your wife cannot travel, get a job. As I understand, if the AOS is not filed, she is technically "illegal" but typically this is "forgiven". I have not heard of any problems with people that were married but did not file for AOS

My advice to all VJers....NEVER use a lawyer unless the USCIS tells you that you have some issues where you would need one. Not likely. This imigration attorney will collect $4000 from you plus fees for AOS and really do NOTHING. What CAN they do? Fill in some two page forms on a computer? That is it. You have to do the legwork, provide the documents, etc. The lawyers have a $12/hr. secretary fill in the forms and print them and charge you $4000??????? (for petition and aos) Ridiculous, it should be a felony to take advantage of people like this.

Wow, 3k for the AOS? Like the others said, if you have a straightforward case, there should be no problem in doing it yourselves. Although no one will come looking for your wife when her I94 expires and you should not have any problems with the AOS because you waited, she will be technically out of status between her I-94 expiring and you filing. Should anything happen to you (God forbid) before she gets her GC, she would probably not be able to remain in the US, so for this and the reasons the others mentioned, it's best to do it as soon as you are able. It will also really help your wife in adjusting to life in the US if she is able to drive, travel, work etc.

10/9/10 - Package sent to Vermont

10/13/10 - NOA1 date, received 10/18
