Timeline

We filled about 5-6 months ago and in july and in october we received a letter asking for more info. It has been 3 months now since we sent out that information to them and my wife still has not received her work permit. We have not had an interview only went to have biometrics take in september. We are starting to feel a little lost. how would we go about contacting some one about this?

Make an Infopass appointment at your nearest sub-office or District Office and find out what is going on with your case.

If it's actually been more than 90 days since you sent the RFE'd information back and you still have no EAD, that's not good. There is the potential they haven't linked up your RFE to the original petition. If that happens, eventually the application for adjustment will be considered abandoned and a denial will be issued.

Of course there is also the potential that the EAD is on it's way and just delayed because of the holidays. Either way you need to find out what is going on.

fyi...we filed for my husband in october and just received his work auth card today....dont know if that helps any......

Join the club. Quite a few of us are having EAD delay problems at the moment. Things you can do in addition to an Infopass appt:

- Contact the offices of Members of Congress. Find out if they have a specialist immigration liaison on-staff and if they do, talk to them and see if they'll look into your case.

- Contact the CIS Ombudsman by email (address here). Attach a filled in form DHS-7001, copies of your I485 and I765 along with their respective NOA1s. Mention in your email all the other things that you've done to try and get a response from USCIS (phoned customer service, made a service request, went to (or couldn't get) an Infopass appt, Congressman, etc). Tell them in the email that you'll follow up by USPS with a signed paper version of the DHS-7001 and paper copies of any of the petitions or NOAs that you didn't attach to the email. You should get an acknowledgement within a few days (I got mine next working day).

Adjustment of Status from K-1 (Very abridged version)

05/20/08 - POE: Chicago O'Hare

07/18/08 - Married

08/30/08 - I-485/I-765 mailed...

03/17/09 - Card production ordered (no notification received!)

03/26/09 - Green card received (196 days)

Removal of Conditions

02/15/11 - I-751 mailed to VSC...

02/22/11 - NOA1 (received 03/03/11)

04/04/11 - Biometrics appt (notice received 03/19/11)

08/22/11 - * * * t u m b l e w e e d s * * * (T+6 months and counting)

09/20/11 - Service Request #1

10/26/11 - Service Request #2

11/29/11 - Interview @ Atlanta Field Office - Approved & I-551 stamped

12/07/11 - Card production ordered

12/10/11 - Green card received (293 days)

Some stats for you ... scary reading in places

People with RFEs - when they applied - RFE date - when they got their EADS ...

Marina & Derek - 2008-06-13 - 2008-07-05 - 2008-12-28

Teresa & Chuck - 2008-08-07 - 2008-10-20 - 2008-12-23

Liam & Valarie - 2008-06-19 - 2008-07-11 - 2008-12-15

Sweety & Baby - 2008-07-17 - 2008-08-08 - 2008-11-24

So as you can see there is no rhyme nor reason to the USCIS processing rates. Because for every person that is waiting that long there are 3 or 4 RFEs that got their EADs in normal time.

My wife got her work permit ordered today, it has only been 60 days, her travel permit was approved also. We filed 11/07/2008 and received approval notices 01/06/2009

hi can i ask a question?i received a biometrics letter i read it and it say only my I-485.but i did no received a biometrics appointment for my EAD?i dnt understand?my biometrics appointment for both?your advice is need my friend coz i have a biometrics appointment this friday.

can you give me information to join the club coz me either i did not received my EAD its almost 3 months now but i received my biometrics letter dec 23 2008 but its say for only my I-485 not my EAD...thats for both fingerprint?or i have to wait another biometrics letter for my I-765?i need your advice.. :star:

I only received one bio appointment letter but it mentions both I-485 and I-765 (it has bar code for each). So, I guess you will receive separate bio appointment letter for I-765 if the one you received only mentions I-485.

My wife got her work permit ordered today, it has only been 60 days, her travel permit was approved also. We filed 11/07/2008 and received approval notices 01/06/2009

So I need to wait another bio letter of my I-765?

I'm not sure if your going to receive another letter. But the biometrics letter we got list both the I-485 and I-765. Maybe your should call and find out what is going on.

01/10/09 NOA1 for I-485, I-130 and EAD received (NOAs dated: 01/06/09)

01/14/09 Biometrics letter received. Notice dated 01/09/2009. Appointment date 01/23/2009 (DAY 15)
