Hello everyone.... First off, I'm new here..... Met my fiancee online by chance (we say by fate (L) ) in March 2005.. first made contact via phone in May 2005....Pete's first visit to the USA was in September of 2005 for two weeks.......everything was perfect...and we knew then there was something there...we talked everynight via telephone at that time... He flew here again in December 2005 for two and a half weeks....and proposed Dec. 27...since then , I've purchased a computer, we talk every night on web cam and with a headset...so at least we can see each other....Pete visited again for my 30the birthday In April 2006....we are filing the petition now....

Question is.... WHATS AN AFFADAVIT OF SUPPORT????? :help: Has anyone filed for it.....????

Any help would be appreciated since we are new at this. :thumbs:

The I-864 Affidavit of Support is a contract between a sponsor and the applicant that is required for some immigrant visas. In this contract the sponsor agrees to provide financial support for the applicant until he/she becomes an American citizen or can be credited with 40 quarters of work (usually ten years). The sponsor must show that he/she has income equal to or greater than 125 percent of the federal poverty guidelines for his/her household size. The legal basis for the I-864 Affidavit of Support is Section 213A of the Immigration and Nationality Act (INA).

Who needs an I-864 Affidavit of Support?

The following applicants for immigrant visas need an I-864:

Most applicants in family-based immigrant visa categories

Orphans to be adopted in the United States (IR-4)

Applicants for employment-based immigrant visas whose relative filed the immigrant visa petition or whose relative has a five percent or greater ownership interest in the business that filed the petition

Please read the Guides up top in the blue tabs, also search for the following forms on the USCIS website. Also, check the Embassy blue tabs up above and Google for your Countries Embassy website, there might be info there. An I-134 is usually required for the interview (some Consulates require an I-864) and an I-864 is required for the AOS stage.

The I-134 is the affidavit of support that you will need to use. Whilst an I-134 is not a requirement for K nonimmigrant visas, it is one thing that a conof can use in determining if the applicant will or wont become a public charge. The I-864 will be used when you adjust status in the US once you have entered on the K-1 and married. Whilst the guides state either/or depending on the consulate, this really should be changed as the only times an I-864 has been mentioned from consulates in relation to a K visa has been India (I think) and they were given an option of using either. It is however stated in the FAMM that an I-864 is not to be used by consulates for K visas.

As others have said....read the guides. There is also a pinned I-134 thread in the Foreign Embassy forum.

Not unless your case is somehow complicated (arrests, overstays, etc) - or if you have money to burn.

I hade that same question when I started this entire process: Should I hire a lawyer? Should I not hire a lawyer? But after much thinking (and consulting my pocketbook, lol), I decided not too. I basically followed the advice of many here on VJ. I asked questions when in doubt, and got a great response from everyone. In about a week, I will be sending in my packet to begin my journey, in just waiting for my fiances signed papers to come in the mail to send it in.

Sorry if I seem confused...cause I am ...lol....but going back to my original question...If my fiance and I are just applying for the K-1 visa... would we have to file that affadavit of support?? He has a 17 year old son... who is in college in Preston, UK and he lives with his mum...So as of now, as far as I know, he will be staying there until he finishes college. Things may change in the future, then we can petition to bring him here if that's what he would want to do... Other than that...the family based visas and worker visas don't really apply to us I think ...???Right??? :huh:

We're going through the UK consulate as well, and from my understanding, you would need the I-134 for the interview so he could show that he wont be living off public funds once in the US.

You would provide proof that you meet the income requirements (>125% of the poverty line) if you are sponsoring him, or if you are using a co-sponsor, that they would meet those income requirements not just for themselves, but with him added into the picture. If you are also petitioning for the son, you would need to prove that he could be supported as well.

What if he's bringing his own funds over... and plans on working... or if his family has money could they sponser him?? I'm divorced and have two children... I do have a good job..I work for a bank.. but I get next to nothing in child support... actually $50.00 for 2 kids!! ..Yes.. We can say LOOSER now... anyhow.. I rent my home... I don't think I would qualify (I don't think anyhow) as a sponser... so then what??.... I ask a family member on my side, or can his family sponsor him???? :wacko:

Yes, for the K1 visa you must do the affidavit of support.

anyone know about sponsoring tho???the ins and outs??? Im sorry.. we are just bareley getting our feet wet.. jut got the packet to file the I129.... trying to get everything gathered up for that that I need... also proof of meeting... Pictures, notarized statements from family and friends that have seen us.. have video also from christmas, easter, and going to the zoo if they need more proof lol
