I have filed my K-1 with the Vermont Service center and am awaiting my NOA2. My fiancee and I wish to marry in July (we should have the NOA2 by then). What do we have to do to notify that are status has changed? Do we have to start over with a K-3? anny response would be greatly appreciated.

A K1 visa allows an alien to come to the USA as a non-immigrant, get married here, and then remain in the USA while adjusting status from non-immigrant to immigrant.

If that's not your plan, you're working towards the wrong visa.

Note also that submitting an I-129f petition to the USCIS is not applying for a K1 visa. An approved I-129f petition qualifies the alien to apply for the visa, nothing more.

I'm just wondering why would you do all the work for the I-129F then throw it away but getting married early?

UMMM, I don't know if I'd rush to do that. Do you absolutely HAVE to get married in July? If you do get married, your K1 is void and you'd have to start over again with the K3 since you would then be spouses rather than fiance(e)s....

And from what I understand, the K3 is taking just as long, if not slightly longer, in some cases, to process, so you might actually end apart longer than if you had just waited for K1...

I'd wait until you have a K1 visa in hand before getting married. Just my opinion! :P

After we have the Packet 3 from the embassy, would it be ok? (if we have that in time for july). The reason we want to get married is so that her parents can be a little more at ease with the whole situation. Obviously, starting over and trying for the marriage visa is out of the question.

No it would not be ok. You can't marry on a K1 until you are approved and in the US.

*January 24 2006 - mailed in I129-F petition

*January 25 2006 - I129-F received at CSC

*January 30 2006 - packet returned.....arggggggggg we forgot one signature!!

*January 31 2006 - sent I129-F back to the CSC, hope we did not forget anything else

Well, if you get married, then the K-1 is indeed out of the question. So you need to figure out a way to smooth the parents' feathers other than getting married before the K-1, or else marry to suck up to the parents and then start over with a K-3 and/or CR-1.

No, nope, not even a little ok. A woman is posting on the Middle East thread right now heartbroken because they had a 'religious ceremony' during the K1 process and as her fiance came into the country her fiance called her his 'wife'. They deported him right then and there as they saw it as fraud. You can't be married until after you get here on the visa.

and just an FYI while I'm crushing your hopes (I feel really bad btw): I wouldn't bank on packet 3 in July if you've just started the process with thise IMBRA mess. We're all in for a long ride...

11/14/2006 AOS packet made it to 'the box' after being overnighted.

12/02/2006 Paul had biometrics

12/14/2006 AOS Forwarded to CSC AND AP Application approved.

01/17/2007 First touch of 2007 at CSC

01/20/2007 Touched AGAIN (also the 18th) come on...

February: Oops, RFE for a REGISTERED marriage certificate. Oops! Overnighted it.

02/28/2007 Paul gets email letting us know his GREENCARD is on it's way! It's done...for now!

03/09/2007 Paul's greencard arrives. And breathe...

We began with mailing the I-129 in on February 27, 2006 so the whole process took us approx. one year.

Getting legally married is out of the question if you intend to apply for a K-1 visa. An alternative would be to have a religious ceremony for her family and friends back in Columbia. Many people have a religious ceremony, which does not make them legally married.

:thumbs: Just make sure that you NEVER refer to eachother as husband/wife and don't have her take any of the photos from the 'religious ceremony' to the interview. People have been denied or made to wait for further investigation just for having engagement party photos that looked like a wedding reception. It's still a risky manuever, but if you decide it's what's best for you two, try it.

But, as Joey mentioned above, make NO mention of said ceremony to anyone remotely related to USCIS or the POE people. Make sure NO pictures of said ceremony accompany your fiancee as she attempts to enter the United states. Make sure she DOES NOT wear a wedding band on the usual wedding band finger. Make sure she DOES NOT refer to you as her husband when entering the US or at the interview.

Technically, you can have a VERY non-committal, non-legal religious/cultural wedding and still be able to do the K-1, but it absolutely *cannot be* a legal service and if a cultural service counts as a legal service (as it does in some countries) don't do that either! And if you do have a religious/cultural service in July, don't show pictures to the consular officer because he/she may be led to believe that you're legally married and you may lose the visa.

We all understand her parents' unease with this whole endeavor (of her moving to the US), but it's EXTREMELY important that you do not get married prior to her getting the visa and entering the US.
