STUCK @ NVC for AP

I thought i read on a government web site something about they will assign a date to a file and will not forward till that date comes. I kinda took that as maybe they have a certain number (quota) for some country's and that anyone's paperwork over that quota has to wait till date assigned to be forwarded. Does anyone know if this is true or not? I do not have a time line yet but i have been in AP for 25 days now ( sept. 3 ) and just called and still in AP

Thats not the reason for the holdup in NVC AP.. that applies to consulate delays sometimes...

Files for your consulate and mine have left NVC in the past couple of days.. we just got pulled for a second look for one reason or another.

Well this is sort of what DOS told me on Sept 3rd - that they were waiting on date for embassy to take our case and i read in another thread they had told some of the UK people the same thing - I know some of us may be seriously having like additional checks done but I also wonder if we are not all like numbered and they really go by our numbers in their systems - like ex - on here 4 (now 5 ) with boghy were all NOA2 around the same time - at that time I thought I was last one as was on the 28th. I know we are small majority of visa filers here on this forum - so could of been like another 10 + ahead of me and boghy. The other 4 were couple of weeks ahead of my NOA2 date - so could of been held over till this back log was clear for august.

I mean if you think about - what that supervisor told me this morning was - if we told you a certain date and something like emergency visa came though and bumped yours or something like this - then yours did not get mailed on date we said - then all heck would break out - which is true. And if you will notice - most everyone who calls even with regular ap time - they always say "NVC said my case was shipped yesterday or the day before yesterday" Very few say - NVC said is shipping today or shipping tomorrow or just shipped" the majority is "shipped yesterday"

I thought I was only one in AP from Romania - but there are 3 of us and still think is 1st time ever - but with the internet - more k-1 and k-3 are being processed - but we still have same number of embassies.

So maybe is ?????

I am so tired of trying to figure out ..lol

I agree ... many K-1's have moved on to Italy in the past 2 weeks, but ours is stuck in AP. It's either random, or they found out my great uncle Fred once jay-walked and they suspect I have criminal tendencies.

Interview ... WAIVED? Never heard of this, but they didn't even interview him, just told him pick up his visa the next day.

Current Status: Interview ... waived ... I guess :) They just took his fingerprints and documents and told him everything was in order and he should pick up his visa tomorrow! WOW

I can't believe it's only been 7 months since we filed ... seems like an eternity!

This doesn't pertain to K-1s. They have immediate priority dates. NVC does this with various other types of immigrant visa petitions that are subject to numerical quotas. They forward cases as visa numbers become available.

Improved USCIS Form G-325A (Biographic Information)

Form field input font changed to allow entry of dates in the specified format and to provide more space for addresses and employment history. This is the 6/12/09 version of the form; the current version is 8/8/11, but previous versions are accepted per the USCIS forms page.

Thanks everyone for your thoughts. We do all seem to be from the same time frame. My NOA2 was on Aug. 26 and NVC receive date was Sept. 3 . It's the not knowing anything thats the hard part. We expect a certain amount of time to go from 1 to 2 but this wait comes out of nowhere and surprises you. I'll be checking 4-5 times a week like I'm sure you all do. I have sent 1 e-mail too with no response yet but didn't really think they would till they are done. Hope we all can get out of AP soon.

The funny part about the US Embassy in Bucharest is the costumer service on the Consular Section. For those who had/will have the chance to get in touch with them, be aware of being rushed on the phone by Romanian employees working for the Consular Section. I do credit them for they acknowledge, being able to speak both languages english/romanian, but be ready for the attitude over the phone.

I'll have to wake up at 4:00am EST to call the (since they like only to be called in the morning) to try to push the Packet 3 for K-1 in one way or another, due to NVC delay and based on the case number. I'm not hopping for much success, but i will let you know guy's how that went, tomorrow.

Thanks everyone for your thoughts. We do all seem to be from the same time frame. My NOA2 was on Aug. 26 and NVC receive date was Sept. 3 . It's the not knowing anything thats the hard part. We expect a certain amount of time to go from 1 to 2 but this wait comes out of nowhere and surprises you. I'll be checking 4-5 times a week like I'm sure you all do. I do not know if its a time frame issue, I have a chat friend who has also filed a week earlier than I did. They already got the letter from the Embassy today, which means it passed through NVC very quickly. However my case seems different.

I received my NOA2 on Sept 11th, called NVC on sept 20 and got the case no. they assigned it and found out it is in AP. Called sept 21 to find out when they actually received my petition because I forgot the first time I called to ask. The lady would not give me any information, she said my name as the petitioner did not match the name of the petitioner that they had. My case was flagged for review by a supervisor and I was told to call back in 15 business days.

I'm going to try and Fax a letter to the Assistant Secretary of State for Consular Affairs and see if I get a response, a long shot but a least I'll feel like I'm doing something.

we emailed them - they are pretty friendly - they told us to down load the forms and mail them in and they would hold for us till our petition arrived - so would be already package 3 complete and they would just sent then the medical forms

so is at least a step ahead in the waiting process - we figure once out of ap - we will only have to wait 2-3 weeks ( if this long ) to have interview - maybe falsely - but if we leave the NVC center this week as the "within the 5 days" - we think we could still be finished by mid oct w visa possibly latest by end of oct

I've called them few minutes ago, and the told me that the Packet 3 forms will be mailed out only after they get from NVC our case. You mentioned that they sent you the forms. Can you give me the info of those forms?

Over the phone I asked the fallowing questions, which you may find them useful.

I asked them how long would take them to mail out the Packet 3 from the day that they get the case, and they told me that would be mailed our in the same day.

I asked them if there are any fees to pay. The lady on the phone said "yes $131 the visa processing fee, that can be paid on the day of the interview inside in the consular section".

I asked "How the interview appointment work? " She said having all the necessary documents requested through Packet 3 the beneficiary she/he will need to call in to schedule an appointment date, which she said shouldn't take more then few days (2-3 days) from the day of calling. I personally found this answer a very useful one :).

I asked "What's the process of the medical exam?". She said if the fiance(e) comes from a different city far away from Bucharest then she/he will need to pay additional fee (small mailing fee) to the medical exam fee, for the sealed letter with the medical results to get to them. This is due to the fact that those results won't be done by 1pm(which is the starting time for interview of those with K-1 visa ). Additional to that i've asked "Will the visa be issued without those medical results ?" - as expected she said "No." therefore is a good idea to have them done ahead of time. A day before - she said.

so this is what we were going by - they did not mail the package - but they said if we did this - would eliminate the need for package 3

One thing to note - is your SO will need your I-134 and supporting docs for this plus new letter of intent - I thought I could just bring these at time of interview - but they need to go w the DS-156K

So ended up mailing these instead

then it appears THEY made a mistake, a clerical error in your file... now guess who will be penalized for that mistake? I would not wait 15 days. I would call them every day, and ask to talk to a supervisor, write a letter (not e-mail but registered mail) and contact your congressman. Well, that's just me, but I don't bear incompetence too easily, particularly when it impedes me from achieving the thing I want most in my life. Maybe you are not in a hurry anyway. Some aren't. As for me, I've waited a long time to be with my Love, and we're both tired of waiting. I don't mean to imply you don't want to be with your beloved, I'm just acknowledging there are different circumstances. Those here who are stuck in AP at NVC and feel some urgency should not tolerate the way they treat us. Why should they tell us blatant lies, then refuse to give us any reason why our petition is stalled there in that black hole, and tell us we should just wait patiently and blindly, when we (most of us) already waited a painfully long time to be with our Loves? I'll call them twice every day. They are public servants, not our Lords and Masters.

Interview ... WAIVED? Never heard of this, but they didn't even interview him, just told him pick up his visa the next day.

Current Status: Interview ... waived ... I guess :) They just took his fingerprints and documents and told him everything was in order and he should pick up his visa tomorrow! WOW

I can't believe it's only been 7 months since we filed ... seems like an eternity!

Thanks everyone for your thoughts. We do all seem to be from the same time frame. My NOA2 was on Aug. 26 and NVC receive date was Sept. 3 . It's the not knowing anything thats the hard part. We expect a certain amount of time to go from 1 to 2 but this wait comes out of nowhere and surprises you. I'll be checking 4-5 times a week like I'm sure you all do. I have sent 1 e-mail too with no response yet but didn't really think they would till they are done. Hope we all can get out of AP soon.

I do not know if its a time frame issue, I have a chat friend who has also filed a week earlier than I did. They already got the letter from the Embassy today, which means it passed through NVC very quickly. However my case seems different.

I received my NOA2 on Sept 11th, called NVC on sept 20 and got the case no. they assigned it and found out it is in AP. Called sept 21 to find out when they actually received my petition because I forgot the first time I called to ask. The lady would not give me any information, she said my name as the petitioner did not match the name of the petitioner that they had. My case was flagged for review by a supervisor and I was told to call back in 15 business days.

then it appears THEY made a mistake, a clerical error in your file... now guess who will be penalized for that mistake? I would not wait 15 days. I would call them every day, and ask to talk to a supervisor, write a letter (not e-mail but registered mail) and contact your congressman. Well, that's just me, but I don't bear incompetence too easily, particularly when it impedes me from achieving the thing I want most in my life. Maybe you are not in a hurry anyway. Some aren't. As for me, I've waited a long time to be with my Love, and we're both tired of waiting. I don't mean to imply you don't want to be with your beloved, I'm just acknowledging there are different circumstances. Those here who are stuck in AP at NVC and feel some urgency should not tolerate the way they treat us. Why should they tell us blatant lies, then refuse to give us any reason why our petition is stalled there in that black hole, and tell us we should just wait patiently and blindly, when we (most of us) already waited a painfully long time to be with our Loves? I just called and we are still there - she but she said could leave any day now - so think I will start calling 2 times a day - we are on day 3 of the "within 5 days leaving"
