NVC Components for I-864 AOS Package

His dad does not have any financial trouble. He's retired but owns many assets.

We are just scared and nervous about the all process

but the question is does hid dad qualify as a sponsor....

Nothing to be scared of... if you do your homework and do your best to anticipate next steps... it is not all that difficult...

He's an american citizen by birth

What are the others requirements?

How was I to know he was a USC... this is the first time you indicated as such.

We have been reading the guide on "how to do at NVC"

Enclosed the list of documents we need:

FROM PETITIONER (Components for I-864 AOS Package) :

 I-864 filled & signed by petitioner (ORIGINAL)

o FORM:

 IRS Tax information - 1 year is required up to 3 years may help.

o Tax Transcripts (FREE) (optional but may help)(Call IRS to get it! 1-800-829-1040)

o W-2s and/or 1099s

o 1040 from most recent tax year

o Pay stubs for current year (6 months should do)

 Employment letter showing your income and position.

o Make sure that position/title is consistent on all forms.

 Sponsor: I-864A and all Tax information as above

 NOTE: Even something as simple as Painter on one form, and Painting on another, could

trigger an RFE (Request for Evidence

We are waiting for the NOA2 and my wife quit her job to come to stay with me in Italy for a while. For this reason we cannot provide:

- Pay stubs for current year (6 months)

- Employment letter showing your income and position.

What can we do? Is that a problem?

do i have to notorize I864 form?

How much cash in the bank account is required to qualify purely on assets for a family of 2?

Will $ 50.000 suffice?

Without current income or sufficient assets to "qualify" as a sponsor herself, you may have but one choice... a joint sponsor

If last year's income was 0, but this year is enough and documented by paystubs and employment letter, is that enough?

Also, another question: what's the difference between I-864 and I-864EZ ? Will NVC tell us which one we have to file?

I think that the current income is what matters for the I864. If the current income is sufficient, you should be ok.

The I864EZ can be used if you are only using income reported on a W2 to qualify and there is only 1 person being petitioned. There are three questions at the top of the I864EZ that you must answer "Yes" to in order to use the form.

The NVC will indicate that you must submit the I864. They do not know if you qualify for the EZ...

Thanks, so if you use IRS Transcripts you cannot use the EZ form? Is it any eazy (abridged version) to fill out?

My wife has income in 2005 and 2006 (overseas,, but recently filed), just not in 2007. Present income can be documented with payslips (would you have to send ORIGINALS or photocopies are ok? )

and with an official letter of employment from her blue-chip employer..

Anyone on the above??

-Are pay stubs to be ORIGINAL or photocopies? How many do you normally file? I think on each pay-stub you have a summary of the Year-to-Date income anyway...

As msnoob stated, the use of the I-864 EZ is qualified by 3 simple questions on the instructions.

1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;

2. The relative you are sponsoring is the only person listed on the Form I-130 petition;

3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s)

As for paystubs...you can send copies, but must have originals available at the interview if required. 6 months worth is sufficient.

If you read question 3 again, it should be clear that "if your qualification is based ENTIRELY on your salary or pension AND is shown on one or more Forms W-2", this is code for anything else is not EZ.
