I am putting together the information that is needed for the Consulate interview. I have been reading a lot about people being denied visas because they cannot prove their marraige is legit. My question is can we get a lot of sworn affidavits from friends and family stating that the marraige in real? Will this work? For the I-130 its states that these can be used when filing:

"Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage)"

If I have 10 of these then they surely can't deny the visa right?

A tip on affidavits: Have the person write a brief narrative about what they know about your relationship and what they have observed. It has to include the info that was mentioned, but a true love story in plai English is pretty convincing.

Ten is overkill. The COs don't have time to read them all. I think three would be sufficient if you are otherwise prepared.

The first key is to actually HAVE and LIVE a bona fide relationship. The best evidence is time together. The second best is evidence of regular communication. Actual preparation for the interview where the applicant's answers about the relationship, what they know about the spouse and family members and personal history etc. You know, the kinds of things people who have bona fide relationship KNOW about each other.

Affidavits from others are way down the list, IMO. People in fraudulent relationships can get affidavits easily enough and most I've seen have made the mistake of focusing on weddings or parties rather than what the affiant knows about the actual relationship.

What more normal "evidence" do you also have? How many visits? How long each time? How many pictures with how many family members in how many different locations? How much do the two of you know about each other, particularly how much does the visa applicant know about the petitioner?

And, yes, you can be denied with 10 sworn affadavits.

Thanks a lot guys! I have been living here in Shanghai with her for 18 months now and we have a daughter. I got the impression from reading on candle for love that the CO's have been denying people for no reason. So thank you for making me feel better about this.

The daughter with US Passport and evidence you've been living together for 18 months is all you'll need to show a bona fide relationship. Relax and put any affidavits in a scrapbook somewhere.

Yeah, you shouldn't have any problem whatsoever! You have all the proof you need in your baby.

I sent them a cable TV bill with my name, and a cell bill with her name at the same address in Bangkok, as well as some photos and phone records. Hopefully that will do it.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

"Give me your tired, your poor, your huddled masses yearning to breathe free, the wretched refuse of your teeming shore. Send these, the homeless, tempest-tost to me, I lift my lamp beside the golden door!"

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Welcome to the USA!!!
