Hi,

I currently am being represented by a lawyer. After a lot of thought, and learning a ton from VJ, I realize that I may be better off going through this process on my own. There is only so much the lawyer can do. If I decide to do this on my own, what do I need to do as far as the immigration process is concerned? What kind of paperwork would I have to provide? Would there be any detrimental effect on the immigration process. I am currently waiting for NOA2 from VSC. The lawyer is the designated as our agent via G-28.

Lawyers are worth NOTHING, NOTHING, NOTHING. Take your money and and throw it out the window if you have that much to WASTE.

Lawyers DO NOT get anymore information than us. Plus, they no nothing of any procedure at any of the Consulates unless they work out of that country.

Also received action to the old WAC petition I-129F to reopen to withdraw petition.

12/01/08 I checked the "NO" box and sent in to VSC.

12/02/08 requested expedite services (need life saving operation)

12/06/08 received email new I-129F back in process mode

12/19/08 denial to expedite petition (unbelievable)

12/30/08 USCIS sending why the denial old I-129F (cant wait to get that response)

01/03/09 Finally received both NOA-2's today, my heart cant take it.

01/09/09 Received 1st letter from NVC for $70.00......no no no I want to process the I-129F. Got my birthdate wrong, have to fix that.

03/24/09 Interview........DENIED HK

Hi,

Well, i don't know why you are so worried. Just look at timelines and see that a lot of people are in you situation.

About the lawyer: I have a lawyer are she is doing whatever she could to find info for me. It all depends on what kind of a lawyer you have. My I130 date is 02/24/08 and I129 is 03/11/08 and i haven't heard from USCIS. My lawyer is using AILA's (www.aila.org) liaisons to find out information for me. The thing with the lawyer is that if in case something goes wrong then you can blame them. Well i know some lawyers are jerk, but i am happy with my lawyer.

Just have patience bro - everything is going to be fine. If you change lawyers then I am sure you will have more problems. The new lawyer is always going to say that the previous lawyer made mistakes. And if you really think your lawyer is not doing anything then change the lawyer because once the time is gone you can never get it back.

Lawyers are not a waste of money if they are good at what they do. Look at my timeline...

Now, if you do let your lawyer go, the G-28 told USCIS that he is the person they need to contact. They will send your original NOA2 for both applications to him, and you will only get a copy.

I don't know if you can notify USCIS that you no longer have the attorney or not, but every time you do something like that, you run the risk of causing confusion and delaying your case.

My lawyer has delayed my case by 3 months minimum. It has been a nightmare. I see good and bad things here about lawyers. Take the $2k they charge you and set it on fire. At least it'll keep you warm for a few minutes.

Just to clarify. It's not that I'm disappointed with the lawyers work. It's just that when I paid them to do a job, I had the expectation they would be able get the job done faster than I would. I realized that my expectations were misplaced, as their primary value is to complete applications, and send/receive documents. Plus they are not saving me a lot of time and work, as I'm the one responsible to send the information to the lawyer for the forms/gather documents and send to lawyer/call USCIS to make inquiries.

I have learned a lot about the process through VJ and also have relatives who have gone/ are going through immigration and I at this juncture just do not see a reason to have a lawyer. Obviously I do not want to remove the lawyer if it would cause any communication delays in the process. We are currently waiting for NOA2 so I acknowledge that I would have to make the move sooner than later because once we get NOA2 things will get faster and more correspondence with the immigration authorities will be needed.

If your case sits on their desk for 3 months, there's not a damn thing you can do about it. There's no good reason for them to do a good job, AND if they don't, there is no re-course for you.

Believe me I considered it. Problem is they already have all your originals. They are considered the agent thanks to the G-28. For myself, I just stuck with it because it would have been much worse if I would've tried to fire them midway through the process. All I can do now is let people know not to make the same mistake I made. For most people this is a once in a lifetime thing, and they know this. So they can pretty much do whatever they want. There is no recourse. Just stick it out, and stay on top of them. Thanks to this website, I corrected many errors they made before it was too late. The latest being they told me to make out my checks for NVC to USCIS, when the need to be made out to Dept. of State. This was just one of many errors. Getting a response from them is pretty much impossible. My view is, even if had gotten an RFE, it would only have delayed my case by a week or two. Not the 2-3 month delay I have because of hiring these incompetent people.

I feel the same way about removing the lawyer from our case. what I'm doing is just letting things run their course. I gave him half up front ($1000.00) and he won't get another dime from me. from before we got our NOA2 for our petitions I was fixing his mistakes. Its funny now cause every time he calls to tell me something that I have to do, I tell him hes about 2-4 weeks too late. I have done the paperwork since August and will continue to do it myself. yes they mailed the original to the lawyer (NOA2), but I got a courtesy copy and that is all I needed. After my wifes interview and she arrives here in the US, I will ask for the original paperwork and say good bye formally to his service. (or lack of service). thanks to VJ, I now feel comfortable with the rest of the proceedings being handled by wife and myself.

Lawyers are gold-diggers! Our lawyer aka Maritza Diaz/John Dorer are just money hungry! Whatever you do-do not use them! OMG! The do not give a d**n if we get approved or not. I wrote them in reference to my case and they said "we have to wait for NOA2". Good grief! Is that the best he can do? What kind of legal advice is that? He even messed up on our papers the first time. God knows what he sent to USCIS. The downside is you never know what they sent and if it is sent at all- until he emails you a copy of your NOA which good because you get it from him and do not have to wait for it to get in the mail. Other than that it is a waste of good hard-earned cash! Go about it alone my best advice to all of you!

I wrote them in reference to my case and they said "we have to wait for NOA2". Good grief! Is that the best he can do? What kind of legal advice is that? He even messed up on our papers the first time. God knows what he sent to USCIS. The downside is you never know what they sent and if it is sent at all- until he emails you a copy of your NOA which good because you get it from him and do not have to wait for it to get in the mail. Other than that it is a waste of good hard-earned cash! Go about it alone my best advice to all of you!

I see in your timeline you have Texas service center. I hope they didn't send your I-130 there. It will be rejected. Only CSC or VSC handles K-3 petitions.

I appreciate everyone's sentiment.

is there anyone in this forum who could share their experience of removing their lawyer from the visa process? What did you need to do to get it done? Did it delay your visa process at all? That's the center of this discussion.

Just curious, but why take your lawyer out of the process. I am not a lawyer fan, but if you have already paid the money and can at least avoid paying more money, why bother changing anything? I wouldnt want to take a risk for problems, but I do agree with the sentiment that you can do it yourself. But maybe they can somehow pull a string or two that you could probably pull, but you have to know to pull it - But I dont think so.

9/3/08: Submitted I-129

9/5/08: CSC received

9/8/08: NOA1 date

11/12/08: Requested expedite (promised response by 11/17/08)

11/19/08: Received status info by calling USCIS - Additional info sent

12/4/08: Call from CSC & "Touch"

12/4/08 to 12/22/08: Too many calls & faxes to mention, NO RESPONSE!

12/22/08: NOA2 Approval!

12/30/08: NVC forwarded petition to Embassy in Tokyo

12/31/08: Letter from NVC stating they forwarded petition

1/4/09: Received Letter from NVC

1/7/09: Packet Issued from Tokyo Embassy

4/18/09: Tokyo still unable to grant interview, moved to Philippines.

6/22/09: Our daughter was born (more embassy paperwork)

6/30/09: Reqeusted transfer of case to Manila

8/26/09: Visited embassy in Manila AGAIN, personally requested transfer of case (no record in their system)

11/4/09: Case Transferred from Tokyo to Manila - no notice sent

12/5/09: Notification that Manila received the case.

12/30/09: Interview packet received from Manila

1/25/10: Medical check in Manila (took 4 days)

2/1/10: Interview - requested additional docs,

2/2/10: Additional docs submitted, Embassy kept passports - expect visa soon.

4/5/10: Received Visa FINALLY!

4/12/10: Entry to USA

Like I said in a previous post, once you sign that G-28, your pretty much stuck with the lawyer you chose. Also, they have all the documents that you sent them. All they do is enter the information that you provide. Take the money you would spend on a lawyer, and buy your SO something nice. It's a monumental waste of money and time.
