OK my girlfriend is from Columbia, she is here in the US( I met her here) on a 5 year business Visa. She has been here 2 years and has never left. The immigration is telling her she needs to leave the country for a month and then re-enter. She can no longer make any money in the US to support herself and 2 kids, any money has to come from Columbia to stay here. If she goes back home to columbia with her family i know she wont come back. I have a huge dilemma, we have been dating for 2 months and i think that's too soon for marriage but not out of the question if i have no other options. I know if she leaves for a month, I may never see her again. Can i get a fiancee vise for her even though she is here? I am just trying to buy some time for us to get closer before we marry, if that happens. I don't want to see her go, it breaks my heart to think about it. Please advise we only have a month (maybe) before i have to make a decision

I am very sorry to hear that but i have no advise yet. does she have a contract for 5 yrs (w/ the company)? if she does cant she use that towards it? did she fill out any forms b4 she came here for employment? honestly, i dont no wat 2 tell u. but if thas what the immigration people r telling u guyz then theres nothing that i can say 2 put ur hopes up but again there is always a way out of the problem. call again. dont loose any hope and hope she does not leave u. good luck :thumbs:

No, you can´t. She has to be in her country for you to place a petition for her

It would take at least six months to get a fiancee visa for her. There is no quick solution if she's not earning enough to stay, but you COULD visit her in Colombia to keep the home fires burning.

If she has a business visa for 5 years and only had spent 2 years in the US why the immigration asked her to leave ? You should see a law officer to get advice. Maybe you can marry her and ask for the AOS before she has to leave. Many people do that.

I think the problem is that she never went back to Columbia, with a business visa they ask you to go back every 6-12 months and then re-enter. Thats totally stupid, plane flights are not cheap. Her contract with her work expired, she could leave for a month and then come back and make a living but im afraid she wont, she is fed up with Immigration and how they treat her like she's a wetback or something. She is highly educated with a teaching degree, CPA degree and a masters in Finance with 12 years of college. She could stay if her income comes from Columbia but she sold that business and no longer has the income. I guess we just need to see an immigration lawyer, even though she has seen one several times. I just wish we had more time before i have to make a decision. I have a busy work Schedule, me going to Columbia is very difficult.

I would assume that she has a 5 year multiple entry visa. If that's the case, your girlfriend just need to get out of the US. To minimize cost, she coould go to another coutry near U.S., not necessary back to Columbia.

Her business visa allows her to stay for a certain period of time in the U.S. and then get out and do re-entry. Any country will do.

You need to know the exact terms of her visa including the period of time granted for each stay. Has she overstayed?

Fiance visas are for actual fiance and require the visa holder to marry the petitioner within 90 days of entry or leave the US. Whether you see her again is not limited to her willingness to return. You are free to travel to visit her.
