Timeline

I need someones help with this. my husbands visa expires on Nov. 6th and his AOS w/ EAD was returned with the following letter.......

B) Your I-485 Application to Register Permanent Resident or Adjust Status is being returned because it must be accompanied by an approval notice for one of the follwing: -A form I-485 Adjustment of Status at least one year after being admitted; as a refugee, granted status as an asylee, or derivative asylum status as the spouse or child of a person granted asylum and eligible to adjust.

He is here on a K3 visa from England....I dont understand and i dont have time to research this. what did we do wrong and what do i need to do???? please help we are running out of time!!!!!!!![/size]

01/28/04-met online via yahoo (hot diggity!!!!)

spoke on online and cam every day for over a year

04/01/05-andy comes to tennessee for 2 weeks!!!!! (double hot diggity!!!!)

06/18/05-andy comes back to stay with me for 3 months!!!!!

12/30/05-andy comes back to stay with me for 3 more months!!!!!!!

****waisted a bunch of time because we both recieved packets and got confused..he was sent

k3/ds papers and i was sent I-864 forms for cr-1....WE GOT MIXED UP!!!!!!!!!

10/03/06-hubby mailed off check list for k3 to embassy

10/12/06-hubby recieved interview date!!!!!!.............NOV 7th @ london embassy!!!!!!!!!!!!!!!OMG

11/07/06-APPROVED!!!!VISA GRANTED!!!! YAY!!!!!!!"

My first impression is the person that sent you this has NO idea what he/she is talking about. Maybe llook over you paperwork and make sure you didn't accidently fill out the wrong item.

MAY 6 2008 ( Day 1) - Notice USCIS received MAY 10 2008 (Day 4) -Rec'd all 4 NOA's & Status of all 4 online

MAY 12 2008 (Day 6) - Received Biometrics letter MAY 14 2008 (Day 8) - Biometrics done early.

OCTOBER 22 2008 (DAY 170)- I-765:Card Production Ordered/I-131: Approval notice sent

OCTOBER 27 2008 (Day 175)- AP Received

Sounds silly, but have you submitted the I-485 form with the packet. Looks like they didn't get it. Also, you need to provide copies of I-94 stating his current status. If you have digital copies of your I-485 check if you filled it out correctly. You might have filled out that he is an asylum seeker.

Well, the only thing i can think of is that i picked the wrong answer on part 2. i picked A. would that be incorrect if he is a K3 visa holder???

maybe that's the approval notice that they want..

Well, we scanned a pic of his visa and attached it to it. would they want the letter as well you think???

hi. i'm also a k3 visa holder.

i also picked (a) of part 2 of i-485. at the same time, i sent a copy of the approved i-130 petition (to support our answer). to date, i've yet to receive an rfe, so i'm assuming i did the right thing. (still keeping my fingers crossed)

perhaps you can try calling uscis. they do answer calls after, er an eternity of waiting!

There is no time limit on filing for AOS, you can file at your convenience. Also, the visa expired the moment he entered the country. He will just be out of status until his green card is approved. Take a deep breath and relax, time is not running out.

The K-3 visa expired when he entered the country. It is a visa for a one time entry into the USA. There is no time limit on when you have to file for AOS. He will not be deported. Send them what they're asking for and wait for the green card. You two are fine, time is on your side.

A K-3 visa is good for multiple entries for a two year period, not to be confused with the K-1. Otherwise, the last poster is right - send them what they're asking for, and try hard to relax, as everything should be okay with your case. Yes, they do need the approval notice (NOA 2).
