Sara, yeah its been eaten by a black hole, our Lawyer has taken to ignoring our calls, and not returning them, Chris calls him about 5 times a day and we haven't actually spoken to him in 2 weeks :(.

We are actually organizing paper work for Chris to come to Australia, and looking at getting married maybe next weekend (after withdrawing our visa application) and apply for the CR1 to america and the Spouse visa to Australia and see which one comes through first, I think it will be Australia.....

Frankly it doesn't really matter at this point which way we go, we just want to be able to get on with our lives together, yes we are aware that we will be doing this for the next 5 years setting up our family and all, but at least that way we can do it together, I don't want to sit around for another 12 months in case they "maybe" find our application...

i completely know what ur talking about and how ur feeling what ever way u make the choice to go my prayers are with u

Yeah should be easy about a 4 month process, but i think ill still post all our steps in here to keep my VJ family updated, besides if all goes well it wont be long and we will get to come back this way.

10/10/2011 - 2 year wedding anniversary - Chris to be granted Australian Permanent Residency

Well, I for one want to join the 6mths+++++ club. We filed in Dec of 2008 and here it is almost a freaking year later and NOTHING except a NOA 1 in Jan, and a RFE in May. Yup we have thought about just withdrawling our I-129F and just going for an I-130 if we don't hear anything by March of next year. What's everyones opinion? What should we freaking do?? :help:

Your timeline says that you received your NA02 in May. I'm assuming you input this incorrectly & it should be your RFE? If so I'm sorry that you've had to wait so long. Have you tried to contact USCIS or your Senator to make an inquiry?

08/22/09: Married on beautiful Mackinac Island, MI

It's taken 18 months from applying for K1 to receipt of Green Card! Thank God it's over until 12/7/11

Hey all, Chris and I withdrew our K1 on Tuesday this week.

We got ourselves a marriage license on Monday however and intend to get married over the weekend and next week hopefully get started on the Aussie process and the CR1 Process.

missing_my_baby, just a word from the "over usicis's #######" if you choose to get married and reapply go down the CR1 route, much quicker and you come into the USA with a Green card in hand, unlike the K3 there is no AoS involved (to our knowledge), this is what the Chief of staff over there suggested was the best route for us.

Yes I did input it wrong in my timeline sorry. :blush: I have tried calling the USCIS and they put in a request for service and was told to give them 60 days, which trust me 60 days in a LOOONG time to me considering I'm impatient. Also I haven't tried to call my senator but I guess I should, however I'm sorta scared because in our community newspaper its been said that he's totally against aliens so I'm not real sure, however what else have I got to lose right.

Sue USCIS, people on VJ have done it. It's called Writ of Mandamus, USCIS needs to realize that they put people family and lives on hold through this long process. Personally, I think anyone who should have to wait 6+ months needs to sue. What would happen if I paid my taxes when I felt like it, and stated, I'm still working on putting my paperwork together and gathering my income information and non-taxable expenses bla bla bla and you'll just have to wait to receive my tax payment...

Sue USCIS, people on VJ have done it. It's called Writ of Mandamus, USCIS needs to realize that they put people family and lives on hold through this long process. Personally, I think anyone who should have to wait 6+ months needs to sue. What would happen if I paid my taxes when I felt like it, and stated, I'm still working on putting my paperwork together and gathering my income information and non-taxable expenses bla bla bla and you'll just have to wait to receive my tax payment...

im sorry i know ur post is serious but i was laughing cuz i remember when we first got back to the states thats sort of what mom told the irs.........wrong answer got audited lol

if ur going to file writ of mandamus u have to try everything available to u to try and resolve it first so that they dont come back at u with oh u didnt try this or that .....most of it is a waste of time but has to be done first.......i know that for me and perviz we were like a few months short of moving to india.....already had the plans and we were looking for cheap tickets after the first of the year.....with their ability to use computers seems pretty stupid that it takes more than 6 months to get anything done........
