My AOS interview was last Aug 5, 2008, and it did not went well as i expected.I think that the Filipina immigration officer was acting different.I dont know if it is her personality or just doing her job.

She questioned me about being on K1 visa, she asked more proof and evidence .

She asked me why I am still using my maiden name in my SSN.My husband and I told her that the SSN office told us that they will not change my last name until I receive my GC.but it went on more questioning.She asked also why we dont have joint bank account.Still my husband and I told her that SSN in my married last name should be change first,for us to have joint account .

I am working as RN(1 full time in hosp. and 2 part time in Nursing facility), and in my paycheck it is still in my maiden name,

but in my RN license ,certificate in some trainings it is on my married name.I took my driving test, but the officer told me that even I passed the driving test they will not release my driving license because they need my GC.

I dont know what to do,I am worried why my GC is still pending.

need some advice on what to do.

That Social Security office told you wrong. You dont have to wait to get your green card to change your card from your maiden name to your married name. All you need is your certified marriage certificate. My wife has her SSN card in her maiden name and we changed it to her married name ( she now has both), and we dont have EAD or AOS yet. Try another SSA office or go back to that one and ask for a supervisor.

Thank you , I tried other SSN office, but they told us that we should need the GC for changing my last name.I dont know what is wrong.

On my Aos interview the Filipina officer, I think she descriminate her co filipinas, I noticed it in her gestures, tone and holistically on how she perceived K1 visa holder.

Why don't you request for "one and the same name"certificate from our Philippine Embassy in the US,that's what i did..just go to the Phil.Embassy website in US and down load a form and send it to them together with a photo copy of your marriage certificate,passport. In that way you can provide this consul an evidence about your new name.

12/13/08 NOA2 received in the mail

12/18/08 Called NVC at (603)334-0700 and talked to a nice lady named Rose. Our case was received on the13th and was sent out to sydney...WE WILL SEE!

12/13/08 NVC received letter and said they sent out to Sydney

12/18/08 received letter in the mail from NVC.

12/19/08 another letter from NVC stating it was shipped out

12/24/08 ARRIVED IN SYDNEY at 10:26 am and signed by tom

12/29/08 CONFIRMED it is at Sydney and Good ol Tom did sign for it LOL THANKS TOM!!

12/29/08 Sydney waiting for paper file from nvc and has it requested

12/31/08 Sydney confirmed through email that the paper file was received

01/05/09 His police checks are done and sent off!!

01/28/09 Kai went to his medicals forgot one of his passport pics and needs two more shots all was good!

2/18/09 medicals ready to be picked

2/20/09 packet 3 sent in

2/26/09 pkt 3 received today takes UP to 10 days

04/07/09 interview....APPROVED!!!!

04/20/09 He flew in ..flight was changed he was 3 hours late BUT HE IS HOME

port of entry took 2 mins!! LOL

04/25/09 WE ARE MARRIED!!!!!!!!!!

Do we need to ask help for our congressman regarding my Adjustment of Status,because I have never heard an update to them.We tried calling the USCIS numbers but cannot speak to live person.

Tru to schedule an appointment with USCIS using INFOPASS. Ask them what is happening to your case.It shouldn't be that long to get your GC. Yeah,Filipinos are like that! They should be happy for other co Filipinos,they have this crab mentality ba.

Actually, you got lucky. Technically, since they married, the K-1 is not longer valid. She's legally here; but without any real status at this point. AOS is needed to change the name on the SS card.

We had the same issues and the norm is for the SSA to tell you to come back with the GC.

The question is, did you get approved or not? The officer should have told you what she had decided at time of interview. If she approved you, then there is nothing to worry about. You just call USCIS to find out about your case and if they won't let you do it by phone you schedule an Infopass appointment. As you didn't get a rejection notice either I think you shouldn't be worried about being denied till USCIS tells you, you are. I actually think the officer would have clearly stated if she would have denied you.

That too is not correct. The K1 is no longer valid once its used to enter the USA, its used once. Period. After that the I-94 is what is valid. And its valid for 90 days. you are supposed to marry in that time frame. You have to wait about 2 weeks upon entering the USA to be in the system to get your SSN card. You get your card, then you get married, then you go and get your name changed on it. It is even listed this way here on Visajourney in the K1 visa flowchart. check #16 thru #19.

You do NOT need a green card to change the name from your maiden name to married name on the social security card. All you need to show is immigration status, according to the SSA website SSA requirements to change name on card

If you came to the USA legally on a K1 visa and have an I-94 in your passport (even expired it shows your immigration status) and you have a marriage license proving you got married, you can change the name.

If you came to the USA legally on a K1 visa and have an I-94 in your passport (even expired it shows your immigration status) and you have a marriage license proving you got married, you can change the name.

Nope. :devil: If your I-94 is expired, you are technically "out of status". It's forgiven once you become a permanent resident. A k-1 visa holder is allowed to apply for or change a name on a SS card up to 2-3 weeks before the expiration of the I-94. After that, you will have to wait for a greencard.
