Can my ex revoke his consent to take child from country?

Timeline

The father of my eldest child gave consent for me to take him from the country and we left and have been here a year now.

Now my ex is saying he will revoke his consent all because i wont put my child on a flight to Dallas (hes visiting on holidays) because of storms.

So my question is can he revoke the consent?? We havent got paperwork in for AOS yet due to still saving!

And if he revokes it what will happen??

04/02/2007 - recieved at TSC

04/06/2007 - NOA1 issued

04/12/2007 - check cashed

04/14/2007 - NOA1 letter recieved

04/14/2007 - touched

06/07/2007 - touched (change of address)

06/08/2007 - touched (change of address)

06/10/2007 - touched (change of address)

06/15/2007 - touched due to phonecalls to csc.

06/16/2007 - another touch due to phonecalls on 15th!!!

07/25/2007 - APPROVED!!!!!!

08/06/2007 - NVC recieved

08/11/2007 - letter received from NVC saying send to London within a week

08/13/2007 - London recieves petition and sends out Packet 3

08/16/2007 - recieved and sent back packet 3

09/06/2007 - medical!!

09/12/2007 - INTERVIEW

09/18/2007 - Additional papers collected by courier

09/26/2007 - Visas delivered by courier!!!!!!!!! YAY!!!!!!!!

This is probably different for each country. I can tell you how it works in my wife's country (Costa Rica)... once a parent gives consent, he can't withdraw it unless both parents agree to withdraw it. You should check with the embassy in your home country.

No he cant revoke the permission, he is trying to use that as a means of getting your child on that flight to Dallas, If he is going to be in Dallas then suggest he gets a flight to where you are if he wishes to visit.

who has legal custody? In this country, no custody is assumed unless paperwork is filed. He most certainly can revoke permission, but he will have to find you & persue it in his court system as well. Its not an over nite thing. I hope you have full primary custody of said child. Otherwise, that is something else you are gonna want to "save" for.

i agree. i've seen these things get very nasty and drawn out; something you most definitely do not want.

Afaik, the non-custodial parent cannot withdraw consent after the fact, ie after you moved. He would have been able to withdraw consent if you were still in the home country, but as you have moved to the USA, it's done and cannot be changed.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Yikes! your out of status for almost a year now, and your in Texas???

there have been issues with people getting pulled over, and the marriage certificate with expired I-94 isn't cutting it.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
