Now i am worried after reading that....

I see the part that says a red flag for engagment short time after divorce and i am scared i fall in that catagory.

Actually i proposed while i was still married but i was waiting for my previous divorce to be finalised.I did wait until my divorce was final before i met my now fiancee in person but i was well in love before we met in person.

i hope this wont cause a problem for us.

If it makes any differance my exwife was the person that filed for divorce from me so maybe that will make the differance.....

Anyone here have any advice ?

I wouldn't call it "advice", but my (now) wife filed the I129f about one month after my divorce was finalised. I had, however, been separated from my ex for nearly two years. It was just a long, tedious divorce.

Anyhow, the issue was never mentioned at any point in the process, and my visa was approved without any trouble.

The initial mystery that attends any journey is: how did the traveller reach his starting point in the first place?

Hi,

I am also worried just like the previous poster because I have the same thing happening to me. Just this week I got divorced in MA, but it takes 120 days for it to be made final. I have been waiting for almost a year for this divorce to take place and I'm sure most of you know how long divorces can take. As it is, I have to wait 4 months to send in my petition. I have been separated from my ex-wife for almost a year now and feel the date the divorce took place should have no bearing on the decision of my petition, definitely not for the 120 it takes for it to be final(which is not under my control). I've been with my fiancee for about 10months now and I feel that is plenty time to justify me wanting to marry her. It just states you have to be free to marry before filing the petition. What, are they going to demand now, you have to divorced for 10 years before you can file a petition. Now my question is should I include an explanation in the petition or at least a brief statement stating my story as not to raise any red flags? I feel they are asking way to much as it in the petition and is just something that is unnecessary, but I will include it if need be. Before you know it, we wil have to be submitting stories of our entire lives detailing every single aspect. Unbeleivable. anyway sorry for the ranting, just needed to vent a little. Any input would be greatly appreciated. As always thanks in advance for all the help.

Aussiewench,

I missed the thread back then, but in reading it now I find it quite interesting. JennT opined that Marc's list of 'red flags' was germane to the 'less is more' evidence issue, and you had a discussion with her over that.

I would suggest that Marc's list of red flags is something that is equally if not more germane to the 'do I need a lawyer' issue. The usual short list of problem items that come up in those discussions is woefully inadequate for defining a 'simple' case. Marc gives us a longer list of issues that can cause problems, especially at certain consulates.

Hello! :) I am new for this forum and generally the whole process, and of course, worrying a lot even about little things.

Our situation is following: after quite a long period of romantic communication via email, phone etc. we decided to get married, because we had deep feelings to each other and wanted to be together. Yep, we did it without even having met in person! :star: We were able to finally meet and got engaged only in 1 year after we decided to marry (we both were about to graduate, with whole lotta things to do and it was a big problem to meet earlier). We spent just 5 days together but it was enough to get convinced we hadn't been wrong about each other. He has had no opportunity to fly to me in Europe repeatedly since then because he is not rich, also busy at work and saving up money for future. Personally we both are okay with it. We were totally confident and positive about each other even before we met! (I know that many people don't understand how it may be possible to fall in love over Internet without meeting and mock at it, but believe me, in our case it was possible B) ) And I don't need him to visit me often, even though I miss him terribly. However, now I got pretty concerned about this detail, after reading about these red flags.... What do they mean by "Brief courtship"? Is long-term romantic correspondence considered to be courting, or only real-life communication?

I didn't care about this question much until recently. Can our case be taken suspiciously? I'd appreciate it a lot, if someone clarifies it for me. Thanks. (F)

I don't think anyone can really give you a straight answer here. Every case is unique as is each consulate.

That said, cases like yours (ie. brief courtship) get approved all the time. And some consulates put a couple with similar circumstances under more scrutiny.

Yes, you're right here. I read a lot of interview reports (on another forum)of girls who passed interview in our local consulate who told many times that even those who hardly spoke English and barely could tell anything about their fiances, got visa regardless of this. So it probably does depend on consulate.
