Hello all,

Does someone have to wait two years after meeting their fiance before filing the K-1 visa? Please enlighten me, I am trying to understand the process and make up my mind about which route I should take (K-1 or I-130).

I am also confused about the I-130. How long do you have to wait after you file the I-130 to file for a K-3 visa?

How fast is Vermont Service CEnter approving I-130s now for the Dominican Republic? Any one from DR?

Your advices would be greatly appreciated. Thank you. Oh, by the way guys, I am new here and happy to be here with you.

In general, if you two are already married, you can't file for a K-1. Right now, the I-130 usually takes three months to process, if there are no complications. Then your DR spouse can apply for the K-3 or other visa and should be interviewed 3-4 months after the I-130 is approved. Good luck.

We are not currently married. I am confused as to which route to take because I read somewhere online that, to be eligible to file a fiance visa, the petitioner must have met the fiance within the past two years before filing. In my case, my boyfriend and I have only been involved in this relationship for six months. I haven't been to DR for five years, therefore we do not have proofs that we met within the past two years. I intend to go to DR in November, but then again I will be eligible to file for him (K-1) two years from that date. Please correct me if I am wrong.

Since I am thinking that I am eligible to file for a fiance, I am thinking about going the I-130 route. Does anyone know how fast it takes to get an interview if you file your I-130 going through DR?

No. They do not care how long you have known each other or been together, only that you have physically been in each other's presence in the last two years.

An I-130 is for a spousal visa. You are not eligible to file for a spousal visa unless you marry first.

Within means within. If you've been together even for an hour in person sometime in the past two years, you meet that qualification. People who have only communicated on the internet can't get a fiance visa petition approved.

If you follow the guides, you'll not see anything about filing an I-130 for a fiance. It would be good to have the US Citizen join you here, since they will be the one filing the petition. A critical need is to read carefully, interpret literally and answer accurately. Even some people with English as their first and only language have some trouble with that.

This is incorrect. Once you go see him in November, you may then file the K-1 at that time. You do not have to wait 2 years from the date you see him, you just have to have seen him at least once in the previous 2 year period prior to filing. So, if you go in November and come back in December, you have seen him in the past two years and therefor are eligible to file the K-1 at that time. If you wait until December 2010 without visiting again, then you have gone more than 2 years without seeing him and are not eligible, and must make another visit (or he visit you) before you are eligible again.
