I've still have NOT got an answer. This includes the fuquin idiot from USCIS I just talked to. She was too STOOOPID to even understand my question. Her answer DA COMPOOTER SAYS ME NO DO NUTHIN 4U.

Let me lay this out in kindergarten fashion so my question can be understood. Surely SOMEONE knows.

POINT #1 : IF CASE IS BEYOND 30 DAYS OUTSIDE PROCESSING TIME YOU CAN FILE FOR SERVICE REQUEST

my main question is in reality what that ENTAILS "BEYOND 30 DAYS"

EXHIBIT A: we have hypothetical or REAL in my case date they received the application (let's do an example, say the date is August 10, 2007)

EXHIBIT B: we have USCIS's posted Processing dates For example , and happens to be current date at the most horseshat branch in its system vermont of September 3, 2007. It's listed that date since mid august.

WHEN DOES SAID CASE REACH the 30 day outside mark???

A) when the Vermont date reaches or exceeds Sept 10, 2007?

or

B) when 30 days have passed since the vermont date exceeded the August 10th example?

or

(most likely choice)

C) go die and burn your marriage licence.

work with congressman in your area. Write him/her a letter explaining your situation & frustation. You can find your congressman via www.house.gov via your zip code. It's really worth a shot. Good luck

I know who my congressman is already. He's kinda busy upkeeping a new beach development here on the lake with bacteria and deadly undertow, and ice squall most of the year.

I've got the stuff here for him, but I've feared playing this card since its THE last resort.

After that fails, where do you go.... you don't game over.

From what I understand USCIS will not consider your case outside of processing unless...

For example...they are processing 9/11/07 and and your case date is 8/10/07.

option c seems a little drastic.... let's cut that one out of the group, 30 days past the date means once they reach the said date of let's say September 11, then you are out of the processing dates by 30 days or more. They are getting close to that date. I would also suggest, like others have even though you do't think it will work, contact you congressmans office...

I-130 Timeline:

12-11-2007- Married my Love

02-08-2008- CSC receives I-130

02-11-2008- Received Hardcopy NOA1

08-14-2008- Approved!!! 216 days...

08-21-2008- NOA2 Hardcopy received

08-27-2008- NVC Receives file, NVC Case Number issued

09-05-2008- AOS Fee Bill and DS-3032 Generated

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

09-15-2008- Mailed Hardcopy of DS-3032

09-16-2008- Paid $70 AOS fee online

09-17-2008- Received E-mail confirming the DS-3032 Agent

09-17-2008- Printed Coversheet for AOS paperwork

09-17-2008- IV Bill Invoiced

12-16-2008- Sent I-864 EZ to NVC
