I had a question regarding the K-1 Visa. My fiance has a multiple entry B-1/B-2 Tourist Visa. I wanted to know if we can file for a K-1 Fiance Visa while she is currently in the United States visiting?

05/04/2006 met real in Romania

2006-2008 traveling RO-USA-RO-USA

10/03/2008 came in USA on B2 tourist visa

01/17/2009 got married

03/25/2009 sent AOS (I-130;I-475;I-765)

04/03/2009 checks cashed

04/06/2009 NOA received for I-130,I-475,I-765

04/06/2009 Biometric Appointment letter received in mail

04/17/2009 Biometric Done

05/04/2009 NOA for Interview Appointment - scheduled for June 25 2009

05/15/2009 EAD card production ordered

05/21/2009 EAD received

06/01/2009 Applied for SSN

06/06/2009 SSN received

06/25/2009 Interview date - Approved!!!

07/09/2009 GREEN CARD received!!!

04/12/2011 Sent I-751

04/19/2011 NOA received for I-751

12/29/2011 GREEN CARD received

04/08/2012 Sent N-400

yes you can, as you start off by you filing for the K1 petition, as long as she is back in the UK to receive the packets when the petition is approved then it will be ok

I am not sure why she would go back to the UK... maybe back to Romania would be more prudent.

If she is already in the US and she did not enter with the intentions of immigrating you can just marry and adjust status. ;)

Agreed, though obviously she won't be able to leave the US for a while. If she needs to, then by all means file a K1 together.

I find this post interesting, since you posted in another forum that you're looking for an emergency visa. Yes, while she's visiting you can apply for the K-1 visa, however she will have to return to her home country for the interview process. Please, whatever you do, don't marry and try to have her adjust status while she's here on a visit in an attempt to circumvent the process.
