Hi All! Me and my fiance are still in the process of assembling the I-129 package... yes, we have a long way to go. :crying: I have been reading posts from this forum and its a big help to us! We are just wondering if there is a certain income requirement that he has to meet in order to petition a fiance visa for me or for it to be approved. He said he must have read something about it before but he cant remember where he found it. Please enlighten us on this.

HELLO!!! first of all good luck with this journey!!! You will do fine. The financial requirement is 125% over the poverty level. for 2006 for a household of two it is 16,500 i believe. Hope that helps a little!

THANX!!! yeah it has been very stressful but we have been quite lucky with everything so far and I am very greatful for that!!! This process will only make your relationship stronger and everything will work out in the end! If you guys need any help let me know! Good luck with everything and just take your time and do everything honestly and organized and you will do great!!

Hi All!

Just wondering if the poverty level changes for different areas in the US. Since my boyfriend lives in Chicago, we were wondering if the requirements would be the same as everywhere else. He is currently making a good wage but he is still concerned about the requirements.

June 19th, 2006 - I129-F sent via Fedex (courtesy of my Honey's work) to arrive using next day delivery

Mid- July - Found out I129-F never left his company but is lost there.....need to gather and try again

August 2006 - Still waiting...maybe not the I-129F route anymore

There are no income requirements to apply for the petition. There is a minimum income requirement of 125% above poverty level to provide support for you, but that does not need to be shown until your interview. If your fiance does not meet the minimum income requirements, he may have a co-sponsor who does.

January 7, 2006 - Mailed I-129F to Nebraska Service Center.

January 27, 2006 - Received NOA1.

April 18, 2006 @1859 cst - NOA2 - APPROVED!

But what exactly the sponsor has to show?past year return filed with IRS or past 3 years?

Also how they consider total income ?

for example a girl has income more than 125% of poverty guideline but she is also studying so most of her income is spent for fees to school and if you deduct these fees from total income it would come less than 125% of poverty guideline...

so please guide us about this sponsorship eligibility ( or the income proof and requirement)

As far as I know, you must show income tax returns for the last 3 years, statement from your bank about how long you have had an account with them and how much money you have, any other details such as Life Insurance, CDs, home/asset ownership, etc. and finally the most recent three pay stubs at the time of the interview.

From what I read the minimum requirement is that the income must be above more than 125% of poverty guideline, not savings. Basically if the situation arises, it proves that your fiance has the ability to earn atleast 125% of the poverty level to support you (even if she has to leave her studies!)...

Consulates vary in what they use to determine if the applicant will or won't become a public charge. If they ask for an I-134 , deductions for schooling etc don't even figure into it. They look at the tax return amount. As for 125%, there is no set amount that is used for the I-134. That figure of 125% comes from the I-864. Many consulates will use 100%, some from memory the 125%. Some don't even use the I-134 at all. Some will ask for 3 years tax returns, some 1 year. Your best source of what is required at the consulate you will be dealing with, is from others going through the same consulate.
