My wife and I are trying to find out if we wait till after our second wedding can we get a 10 year green card or are we still going to have to get the 2 year version first

To stay in the US, a green card is necessary -- first the two-year one. You marriage must be legally recognized by law...not be just a ceremonial wedding prior to the "real" wedding.

I *think* the OP means second wedding anniversary maybe? To the OP: Just curious...why would you stay out of status for that long just to see if you can get the 10 yr card and bypass the 2 yr card?

My marriage is older than 2 years. When I had my AOS interview, the officier told me that I would not have a 2 yr conditional GC. She said I would have a 10 year card issued to me.

I have not yet received my card, so will have to see.

This is incorrect. If by the time your Green Card gets approved you have been married for 2 years or more, you will receive a 10 year GC, not the 2 year conditional one.

Note that it has to be 2 years at the time it gets approved, not when you file for AOS.

We never got the two year. Only the 10 year. If you are approved after your 2 year anniversary your are a permanent resident not a conditional resident.

The CR-Green Card expires 2 years from issuance, you apply to remove conditins within 90 days Before the card expires.

Only thing 2nd wedding anniversary has affect on is if you were married more than 2 years BEFORE becomong a US Resident, that is getting an immigrant visa, OR if AOS was approved after 2nd wedding anniversary, then instead of getting a CR-Green-Card you would have got a 10 year card. 2nd wedding anniversary has no affect on when you file to remove conditions.

Exactly correct. Those who don't know what they're typing about, should really keep their hands off their keyboards.

As for the OP, since there's no timeline or profile information it is impossible to reliably comment on whether waiting is a good idea for you.

Thanks for clearing a few things up. As for the why I would wait my wife and myself are notorious tight wads and will choke a penny to death. Plus our 2 year is in Febuary where as her K-3 visa is valid till the end of Sept. the third and final reason is we are finishing the medical exams (she was pregnant when we got the K-3) and saveing the last of the fileing fee. Once again thank you all for the quick response to our question.

If I were you, I would wait, so she can get the 10 year one :thumbs:

I wanted to wait as well, but my L1 visa expires in April 09 and my second year anniversary is in July 09... and I have to file for EAD at least 3 months prior expiration of my work visa so I can continue working.

I guess I'll just hope I will not get approved before next July! :lol:

Okay guess I learned something new then,not everybody gets approved within 3 months like I did.

Gees I cant even imagine waiting 2 years!

It's not that you are waiting for approval for two years, but some of us choose to wait before we even send them in. We probably have the record. (almost 5 years) Yet, after we sent in the paper work she had her 10 year green card in hand in 134 Days. If I could go back and do it again we would've never waited that long.
