Bank account question !!

Hi All VJ ers,

Writing to ask a specific query.As some may have read earlier my husband came in a B1/B2 visa for 2nd time in USA and this time we married after his 84 days of stay. Now we had him opened a joint chekings account last last time to keep the money secure.Now this time we had him opened savings account , just after he arrived to get some money interest .... as he was carrying some good amount of money for his 5 months of stay ...but ultimately we decided to marry.

The bank has`nt asked us anything earlier.Now today morning I got a call from the bank saying he has to fill a form for his savings account that every immigrant has to fill.They wanted his homeland address. My question is :

i) Is it ok to fill such a form ................ can it jeopardize our AOS ?? or is it advisable that we close that a/c ??

ii) When we show the joinmt accounts as evidences , do they want to see when the account was opened ?? or showing the latest statement wd do ...he asked would the IO frown upon it because it was made before the wedding?

I am sure it is form W-8 which is because he is not yet a PR

Has nothing to do with AOS nor will it affect it

They will want to see commingling of your lives.... Length of common ownership, as well as commingled activity is certainly better evidence than simply showing for example, a bank account that was opened 1 day before the interview.

On the flip side, a commingled bank account that was opened BEFORE you made a decision to marry might not be so good as you are trying to assure them that intent was not to immigrate upon last entry.

i think this is a very imp thing and something has to be done .....whats ur advice ??

I am not sure you need to close it.... They will not know about things unless you present it.

You will want to think about your individual facts and circumstances, and then think about the possible questions that might arise from every piece of evidence you provide.

I would not bother closing it. We opened out joint account ages before we got married, for the same reason as your husband. The statement I included in our AOS package was from the week prior to our marriage.

I don't think they are "out to get you". If they ask when you opened the acount, just be honest and explain - you don't have anything to hide. Evereyone knows it is generally much easier to use a US account than pay huge fees to use a foreign one while in the States. For example, I was paying an extra fee everytime I used my Canadian credit card, or every time I used my debit card to withdraw cash.

i thought i wd wriote more clearly and get some more suggestions :

As you may be knowing I am the USC and my husband here is from India and he is adjusting from B1/B2.

This is a summary :

*He entered with B1/B2 in Sep,07 and went back in Nov,07 though he had visa till dec.

* He entered with B1/B2 on March,08 for a 2nd visit as strong proofs for K1 and helping me in some fairs and dvds .

* He had 1 yr Multientry from his consulate and his return ticket is for Aug,2008...but POE gave him I-94 expiring on June 14th,08.

* We decided to marry on 20th May ( approx )

* We bought our marriage certificate on 2nd June,08

* We got married on 9th June,08

*waiting for marriage certificate and assembling AOS things.

Now we are holding 3 accounts here in usa :

i) One joint cheking account opened during his 1st visit in sep,2007

ii) One savings in his name opened in March,2008 after he arrived this time.He was carrying travellers cheque , some good money intended for 5 months.Thats why i wanted his money shd get some interest.

iii) The third savings account which I am holding since 2002 .I included his name in this account 1 day after we gort married.

NOw we are intending to close the 1st and 2nd account since we understood that showing those 2 accounts as evidence may jeopardize our case and may lead them to question us more.the 1st a/c was created as his money wd keep fine and safe there.We didnt close it as we were planning to do K1 and thought to show it as evidence later.The 2nd a/c was created to earn him some interest and to show more evidence.BUt then we got married here only after almost 2.5 months of stay.

Yesterday morning I got a phone call from the bank asking me if we can come and fill up a form regarding the 1st two accounts.When i asked what is this all about she told me that want to know his visa status and his homeland address.

i) Any idea what this is ?? Since his I-94 has expired , is this some kind of danger ? can u give me ur expert idea ? someone told me in the forum may be a W-8 form. Shd we fill up this form and close those accounts ???

ii) we dnt want to hide anything from USCIS........ but do you think this can raise red flag if we sghow the 1st 2 a/c s and let them question us more aboput the intent.I dnt think the 1st cheking account we opened together on his 1st visit can be held as a red flag of intent as he went back after 2 months of being here ,though he had a 3 months visa.

iii) what will be good ?

Close the 1st & 2nd a/c now

OR

Keep it and dnt show it

OR

Show it and tell them the reasons why we opened it and kept it alive.Though there is only $4 in those accounts.

Oops forgot to add that the recent joint Savings account has lots of online transfer to the earlier cheking account as he uses the card in daily work . So teh account statement also shows the transfer details.So inspite of this will it be ok to show only the recent savings account ??

Also will we have to show the bank account statement or the document that bank gave us while i included his name in my account is enough...........

he came here 1st time to attend some fair where we were announcing an upcoming book for which he has done the entire designign and illustrations.This time he came because we wd be inaugurating the manin book.He is a freelancer.we met 1stly in a match site but soon we discovered his art side and then he offered to help me. Wwere dating each other online from before his 1st visit but then we committed to each other after he stayed here for 2 months and decided to go for K1.But during his this time visit we decided to marry.Hope i said u more than u wanted to know !!!1

I wouldn't worry about it. Just bring some recent statements, like from the past 3 months or so. That's all they need to see really. Just don't bring one from before the marriage so you don't create unnecessary questions for yourself.
