Adjustment of Status

I got here to the US and married my fiance only to find out after the marriage that he does not love me as much as before. He wants us to separate but willing to help me in my AOS since he felt responsible for bringing me here. How do I go about adjusting my status to become a lawful resident? I cannot go back and face the humiliation of my failed marriage. Please help.

Read the guidelines - you have to file I485 and will need a sponsor to do the I864 (your husband will be the best bet.) Its not hard - just several documents to submit. Also take a look at the example forms here on VJ. Good Luck

They can still proceed with the AOS process even though they are getting a divorce? Is that possible? Even if the ex-husband is willing to help her do the paperwork, isn't MARRIAGE to a USC required in order to adjust status? I've read in other posts that there is an exception for someone who has been abused but that isn't the case here. I'm not saying it can't be done. This information is just new to me, that's all.

Well actually the way I interpreted it is - they are separating but he is willing to help her go through the AOS ( a few more months at this point.) So, it's not a divorce at this point. At a latter stage she can prove that the marriage was entered in good faith when she goes for her permanent Green card (in 2 years.) So, I still believe there's not much to worry about for the AOS. the divorce may or may not cause a probel for the permanent Green card later on. Good Luck

We all make mistakes. Not saying it was a mistake for you moving, but we all have to try things, and sometimes they just don't work. I'd go back if you're really not happy and are just staying there because of being humiliated. We wish you the best of luck and hope you get what you want.
