I-751, Wife has temporary GC and stepdaughter doesn't

Hello,

My wife and her daughter came to US in summer of 2006. Wife had a K-1 visa and daughter had a K-2. My wife received a temporary green card but daughter was interviewed on 12/6/2006. Daughter has a written statement in Russian passport I-485 pending Sec. 245 and didn’t receive green card until 10/2008.

We have to send I-751 to remove condition of residence from wife and stepdaughter’s green card, but step daughter didn’t receive temporary green card.

I had Infopass twice in NYC office and called 1800 number, but didn’t get any answers regarding stepdaughter’s case. I don’t know what to do. Could you please help me with this situation?

What is the date of expiration on your step-daughter's green card? It is likely that you will need to file a separate I-751 within 90 days of her expiration date. I will be doing that with my stepson at the end of the year.

I made a mistake in my original post: my stepdaughter never get permanent green card until now. Thank you for your help.

is it within 90 days of her mothers expiring?

i just sent a joint petition for my son and I.

My card expired may 25, his will july 19th, so i could send them in together.

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

Are you saying that the daughter received a 10 year card? If so, then no removing of conditions is required for her. If it is a two year card (just issued 10/2007? Your post said 10/2008 which is impossible) then you can try to piggyback her on the mother's I-751.

I am sorry , I made a mistake in my original post. My stepdaughter never got first permanent GC.

We have to send I-751 Form soon to remove the Condition of Residency from my wife First Temporary GC.

I do not know what to do, because my Step does not have First GC.

I would recommend including your step daughter along with the application of your wife. It seems that they arrived at the same time so I would go on the assumption that the right to a permanent green card should be the same. It will of course cost a little more, but you would have to pay for her green card later anyway. So, do both of them at the same time. Since you don't have a green card for your step daughter you have nothing really to lose. Maybe this time they will actually give her a green card with a 10 year life.

Still can't understand why your stepdaughter doesn't have or didn't get a GC!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

I do not know why my stepdauhter did not get a GC.

She /Visa K-2/ came to US with my wife/Visa K-1/ in summer 2006.

We sent Two I-485. My wife had an interview in NYC office and got First Temporary GC in December 2008.

My Step had separate an interview in NYC office in December 2006 and after an interview got written statement in her Passport:I-485 Pending Sec. 245. After the interview we did not get any Notice about my Step case. Thank You. Alex.

Yes. But My Stepdaughter did not gei First Temporary GC.

She had An interview in NYC Office in December 2006 and after interview got written statement in her Passport: I-485 Pending,Sec.245. After An Interview We did not get any Notice.

If I will not get better idea,

I am thinking to send one I-751 Form to Remove the condition on Residence of my wife First Temporary GC

and put my stepdaughter name in Part 5 of my wife's Petition.
