I am in the process of filing 129F and eventually K1 Visa for my fiancee. My fiancee and I are planning on having a family right away. If I submit 129F and my fiancee is pregnant, how do I declare that in 129F application? Do I have to submit addendum form for the update? Or could I use the existing 129F form for declaration?

Or do I have to wait for the birth of my child before I could file 129F? How does it work anyway? Please advise. Thanks in advance.

Hi,

You can go ahead with filing the I129F. At this point the your fiancee's pregnancy is of no interest to the USCIS.

All the best for your journey. May it be a speedy one.

What will need to happen after the baby is born, is to file a "report of birth abroad" with the Embassy and get your child a US passport.

Facts are cheap...knowing how to use them is precious...

Hi Steve's Girl,

Thank you for your prompt response. I will go ahead with the filing as suggested. Do I have to make any declaration regarding her pregnancy during the filing process at all?

I am very thorough with my documentation and want to ensure the documentation properly filled out. And am hoping this would be a speedy one. Again, thank you much for advise and I will keep you posted along the way.

A child is not a child until birth... This child (if yours) will most likely have a claim to US Citizenship... USC's DO NOT need a visa..

YMMV
