Affidavit of Support: Tax Returns

I just sent off my I-130 form today and I'm trying to plan ahead for the rest of the process. I see that I will need to send in an Affidavit of Support with tax returns for the past 3 years. In 2005 I was a student and unemployed although I'm pretty sure that I had sufficient income to show on my 2006 and 2007 returns. If I can't show any income for 2005, will I have to use a co-sponsor?

I'd appreciate any feedback I can get.

I don't think you would need to worry too much. If you get an employment letter from your current employer and have adequate proof of income for the time you did actually work, I think a short written statement/note with an explanation that you did not work in the year 2005 should be sufficient. There are more knowledgeable folks on VJ, but that's my two cents :)

5/24/10 : I-751 Packet sent to VSC

5/26/10 : Delivered to SAINT ALBANS VT 05479 @ 11:46am

5/27/10 : NOA1 Date (based on scanned check image)

5/28/10 : Funds withdrawn from bank account

6/04/10 : NOA1 (I-797) received, confirming above NOA1 receipt date.

7/31/10 : Biometrics letter received - Appointment date of 8/11/10!

8/11/10 : Biometrics done!

8/29/10 : GC received (sometime last week lol)! (WOW!)

Previous timeline of our Busy 2008!!

1/06 : Married my JAAN :)

1/15 : I-130 and I-129F sent to Chicago Lockbox

1/17 : Both petitions received @ Chicago

2/27 : Check cashed & I-130 petition visible on system.

2/29 : Received NOA1's! Notice Date - 2/22/08

5/01 : I-130 APPROVED!!! (But not my I-129F)

5/08 : Got Case # from NVC (received 5/7/08)

5/11 : PAID AOS Fee Online -- I-129F still pending; full speed ahead with I-130!

5/12 : Neetu emailed NVC re: DS-3032 (choice of agent)

5/13 : AOS Status now "PAID" -- AOS PRIORITY MAILED

5/16 : NVC received AOS

5/19 : DS-3032 email accepted & AOS entered in system

5/24 : IV Bill Invoiced and paid online

5/28 : IV Bill status = PAID -- DS-230 EXPRESS MAILED!

5/29 : NVC received DS-230 at 11:01 am

5/30 : DS-230 entered into system

6/03 : CASE COMPLETE - 26 DAYS AFTER NVC RECEIVED I-130

6/10 : Interview scheduled (for 7/9 originally)

6/14 : Interview letter (my copy) received.

6/16 & 6/21 : Medical

7/16 : Interview completed - APPROVED!

7/21 : Neetu picked up passport/brown packet from VFS

7/25 : POE AT EWR!!!

End of Sept: GC received!

They only looked at my most recent tax returns. You should be fine. An employer letter will help make sure your employer writes when you started work and what your annual salary is. You should be O.K. All the best on your journey! :star:

You may not need a sponsor. It depends on the details of your situation. If you were not required to file by law, print out the exception on the IRS website that applies to you and write a brief letter 2-3 sentences on the print out stating why you did not have to file. What if you never had any income for 3 years, but the year you file you have a very high salary, many times above poverty line, and lots of savings?

They only looked at my most recent tax returns. You should be fine. An employer letter will help make sure your employer writes when you started work and what your annual salary is. You should be O.K. All the best on your journey! :star:

Cannot provide something that is still NOT accepted by IRS. 2008 is NOT over yet and therefore you cannot file your taxes for 2008, can you?

WHAT IF you just started working on Jan. 2008?? Would an employer letter suffice?

they state that u do not have to provide ur past 3 yrs returns..just the yr ur filing

I just did mine the other week:

1) they only want the previous 2 years if it helps your case. They do want 2007.

2) Pay stubs are good, if you have them (6 months worth).

3) Get an official letter from the employer.

4) If you have money in the bank, that can help if it's 4x the difference that you need (look at the form). I got a bank statement notarized to go with my file.

5) I wrote them a cover letter and briefly explained the situation (I was also in school like you).

Wedding in Vietnam: 12/25/2005 (graduate school, below poverty line, couldn't apply)
[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit
[b]Nov. 5, 2010 Approval letter sent.[/b]
[b]Nov. 19, 2010 Visa picked up. Arrival: Nov. 24, 2010[/b]
