Since her passport will be from her native country (Mexico) after marriage changing of her name the name on the passport will not be the same. Will we be able to get a US passport while the AOS processes is going through for International Travel to see her family or what needs to happen to leave and re-enter the country if passport name does not match because of the marriage name change?

jlh - she needs to buy her airline tickets in the same name as on the passport. When entering USA she shows them her greencard at the POE. She can apply for a US passport after she gets citizenship - she can apply after three years of being a resident here. She could also have her passport reissued in the married name by the Mexican embassy. Good Luck

In order to obtain a US passport, she would need to be a US citizen. For reentry she will need either her green card or advance parol (AP) - if those are in her married name, she should carry a copy of your marriage certificate. :thumbs:

If she is a mexican citizen she will not be able to ask for an american passeport, she would need the american nationality for that.

To leave the country while pending AOS you need the AP (advance parole) that allows you to come back in the country legally. If she leaves without it you will have to file for a spouse visa and reaply for AOS, so don't try it).

Paper wise when it comes to the passeport itself, you can either get in touch with the local Mexican consultate/embassy to have the name changed on it. Or else, when getting plane tickets get them in her middle name. Make sure she has a copy of her marriage certificate with her in that case since the AP will be in her married name.

What if she has her married name in her passport on a K3 visa? Would that be adequate for travel under her married name?

If your passport is in your married name, book the tickets in your married name.

If your passport is in your maiden name, book the tickets in your maiden name, and carry a copy of your marriage certificate in case you are asked why there is a discrepancy between the passport/tickets and USCIS paperwork.

If I remember correctly, a K-3 visa is a "multiple entry" visa, so AP is not required???? Someone who knows will pipe up with the right info, I am sure. :)

Assume the K3 visa is in the maiden name and the passport that it's inserted into is in the maiden name.

If my wife does a "name change" consider the following question:

Is it possible to get a new passport with the married name and use the old passport (with the K3 visa) to enter the US? Is there any formal adding of aliases to the K3 visa?

My understanding is that if the original passport expired that the K3 visa in the expired passport would still be valid until the expiration date and you'd just carry both passports. Is the same true if the name in the passport has been changed to the married name?
