Child not included in I-129F application

Hi All,

I and my Fiancee decided not to bring her daughter in the US (for now). My finacee's ex-boyfriend (dad)would not want her to go.

Anyway, we did not include her child in the I -129F application. Did not mention she has a child.

I am concerned now if this would cause us problems. She has a child but did not mention it in the Application.

Please help. We have been waiting for so long and any delays or problems would be very hard.

The I-129F is a petition. Many people are confused enough to fail to list children who aren't intending to immigrate, so this isn't a deal killer and there is no need to amend anything. However, on future forms that ask that children be listed, list the child.

Facts are cheap...knowing how to use them is precious...

I thought it wasnt necessary but my now husband explained the wording wasnt name children who intend to emigrate with you - it was asking for children to be listed. I presume that question is there for a reason.....perhaps someone else can elabourate?

I have fingers crossed that it wont impact your petition....and good luck.

On the I-129F it's just to identify children you have in general - not who is immigrating. I'm assuming it's so they know what responsibilities/ties the parent has to home country. The who is immigrating part comes into play when you do the packet 3 documents. It will then specifically ask who the children are and if they will immigrate with you. You can probably just clarify this at the interview stage but definitely include their names in the packet 3 documents and just mark they are not joining you.

This kind of thing happens all the time. They'll understand.

I did list my 20 year old even though he wasn't going. They may ask in case they want to emigrate later and there is a paper a trail but I have no idea.

K-1 journey, AOS/EAD and ROC in my timeline

2011 March 31 - Sent off Naturalization pkg overnight to Texas

2011 April 1 - Arrived in Texas at 10:21 am

2011 April 1 - NOA (rec'd via snail mail April 8)

2011 April 7 - Cheque cashed

2011 May 5 - Biometrics (letter rec'd via snail mail April 15)

2011 May 9 - Placed in line for interview scheduling

2011 June 13 - Rec'd yellow letter (no change in status online)

2011 June 23 - Rec'd text that my case has been scheduled for interview

2011 August 1 - Interview (rec'd via snail mail June 27) PASSED

2011 August 3 - Rec'd email that my case has been scheduled for Oath

2011 September 1 - Oath ceremony (rec'd snail mail Aug 5)

2011 September 1 - All done, yeah.

I believe one of the reasons for adding the children is to check that those of us who should be paying child support etc are doing so. I have seen a couple of threads on here where K1 petitions were refused because of outstanding payments in the immigrants country.

I am guessing the past - Moving to a new country was seen as a dodge for keeping up responsibilites, the US actually has reciprical arrangements with a few countries, where by their Child support people will get involved if say I stop paying support for my children still in Australia
