Hi all - so did something incredibly stupid and went to visit my fiance in Argentina with all of our documents put together for packet three. We were about to send it in when I realized (idiot that I am) that I hadn't had the affidavit of support notarized. If you're out of the country you can have it done by an immigration officer, but again I'm an idiot and we were doing this all the Friday before I was going to leave. We called the Consulate in a panic (After 5!! I'm seriously an idiot!) and the friendly guy told me that the immigration officer next to him said the affidavit of support no longer needs to be notarized.

Is this just an Argentina thing? Is it real? Should I now run to get another version notarized in case they request it?

Two things... The I-864 does not need to be notarized and that is the affidavit the IV unit at the consulate is most familiar with. They may have made a wrong assumption when they answered your question thinking I-864 and not I-134.

You can get it notarized at the US consulate in most if not all countries. Good Luck

again, they might simply have defaulted to the answer for the affidavit they are most familiar with... I would have specified I-134.... I would call back

Thanks for your help - I actually already emailed them and I'm still waiting for a reply. I was just hoping that someone out there in VJ land might know.

I surmise that the requirement for notarizing any affidavit of support has been removed by policy but that only the I-864 forms were updated. The I-134 form just hasn't been updated or replaced to remove the notary signature block.

I may be going out on a limb, but I think that everyone (or most everyone) in VJ land would say... it needs to be notarized

I would advise anyone to notarize it and since the OP has left, they can send a new notarized one.

At the same time, though I think the Consular officer will let an un-notarized I-134 pass, since it isn't binding anyway and the binding I-864 no longer requires notarizing.

Oh thank you for not thinking I'm nuts! I just had a big sigh of relief when I read your response. Of course I'm going to get a new one notarized anyway, but I don't want this process to go any slower than it already is.

Hum...

My I-134 Affidavit of Support needed to be notarized. You know why?

On the bottom it says "SIGNATURE OF OFFICER ADMINISTERING OATH"

And there's a stamp of the office as a signature and etc. In the stamp you see "NOTARY PUBLIC-OREGON"

So yeah I think you do need yours notarized :o

4/07 - Filed the I-129 F [Petition for Alien Fiancé(e)] Along with Bio forms [G-325a for both of us]

6/07 - Forms got resent back to my Fiance because I forgot to sign some papers. [silly me]

11/28/07 - Got my K1-Packet 3!!! It was a headache to fill in the papers.

2/15/08 - Sent all documents and forms through express! I was close to the expiration date

3/27/08 - Interview letter!!! I was in the US with my Fiance so I couldn't come back in time, rescheduled appointment.

4/24/08 - Got my interview done :) Approved! Passport+visa+brown envelope will be sent within a week.

5/1/08 - Got my Visa!

~ Flying to US on 6/11/08.

~June 19 2008- Married!!!

7/25/08 - Sent in AOS: I-485 along with EAD, AP.

8/7/08 - EAD, AP, AOS touched.

8/19/08 - Got an RFE for I-485... Fixing it.

8/22/08 - Biometrics taken in Portland.

10/08 - Another Bio (for work authorization card).

-- received my work authorization card and advance parole papers in meantime--

1/15/09 - AOS INTERVIEW *faints* in Seattle, Washington.

2/2/09 - Green Card!

Hi Lizc,

The I-134 needs to be notorized. There is a woman in the BA embassy, the one that handles the Q&As at the immigrants division, who is very helpfull, but I've caught her making a few mistakes, maybe this is the case. Don't freak out, when's your interview? if you don't have time you can have it notorized at the embassy, if you have time then when you go back to the US have it notorized and send it to BA through UPS or DHL, they do a lot of business in BA so it takes 24-48 hours to deliver. Don't use Fedex as they are not really good in Argentina.

The I-134 needs to be notorized. Just to keep you in the loop... I finally got an email back from the consulate and it seems (sadly) that you all were correct.

"Thank you for contacting the Immigrant Visa Unit. There must have been a confusion withe another affidavit of support (I-864) which does not need to be notarized. However, the I-134 needs to be notarized. So please contact a Notary Public in the US or an Immigration Officer in order to have the form notarized."

I should have known better, but one has to dream! Thankfully I had a new form notarized and it is already on its way to Argentina.
