Hi again!

I am in the process of filling out my I-864 for my husband's AOS. Yesterday I was able to get both mine and my father's 1040 (1040EZ for myself) and our W2s from my uncle (who works for the State Tax dept. so he filed ours for us). I know I will need to obtain copies of our tax returns for the previous two years before the 2007 returns for the interview, but as of now I do not intend on sending three years worh in, because we do not want to wait to apply for AOS.

But I have a problem. I did not work in the year of 2006 (well, I'll correct that - I worked, but it was under the table so I did not file taxes that year). I lived on campus and didn't have a car so a job wasn't really happening. Anyway, I was looking on the I-864 and saw that you have to give details about your last 3 returns. Since I did not work, do I just put a zero and attach a letter explaining that I did not file because I only worked under the table?

Also, something I really haven't understood - my father is being a co-filer or what have you, since I am a student and work only part time. I live with my father for now until Kyle and I can work full time and afford rent. Does my father fill out an I-864 in addition to mine, or does he just need an I-864a? I've become a little confused based upon what I have read. :help:

But couldn't we do that then? Since it is my father and we live with him? I think this is where I am confused.

"worked under the table" could be an admission of a criminal act, so be careful with what you are saying and doing. If I was you, I would declare my income and file the return - not getting a W-2 or 1099 is no reason not to file a return. And admitting that you worked illegally is cause for concern. Good Luck

The only thing I can tell you about the affidavit that it's not required to show three last years of the tax return. It's last year what they want to see. Two previous years are optional, so don't worry about it. (Read Section 25, first paragraph of Instructions for I-864.) We're filing for my AOS this week, too. I'm planning to photocopy only the 2007 tax return info, that's it.

So it is not required for me to fill out all three years in section 25? Even if I do not check the box am I still supposed to fill in the tax year and monies made?

And as for the working under the table, it was like, $20 here and there for babysitting and other odd jobs that I was just paid cash - no steady flow of income that was kept track of. "Working under the table" is just the way to describe what I did because I still performed a job, but it wasn't anything steady or enough to require my keeping track of - at least not in my opinion.

My grandfather is a former IRS auditor and also a former Tax preparer as of this year. He told me a few years ago, when I didn't have a job, that the IRS doesn't care if you only make less than $10 in a calendar year, but if you make more than that, regardless of whether a W-2 or 1099 is issued, you are required to keep track of your income and file your income taxes based off that. You, like everyone else who works, even under the table, have a tax burden, and if you are skirting paying any taxes on your actual income, no matter how small, you are not being honest and you are not being a good law-abiding citizen.

I only sent in two years of tax returns (2005, 2006), plus last year's W2 (when I filed in January, I didn't yet have all the documents I needed to file 2007 taxes). I just noted in the financial sponsor's form that I was a student in 2004 and didn't file taxes.

I haven't gotten any RFE's yet. We'll see if they give me any trouble at the interview next month...

I guess that means when I was 12 years old and babysitting the kids next door for $5 I should've reported that too? I guess I really am a bad citizen...

My Uncle works for the state tax department and told me I was fine. The consensus when I searched this online was that if you made less that $400 a year, you don't have to file. And I didn't make that much in 2006. I had no tax liability.

Are you sure you want to tell them this? It's called tax evasion, it's a crime punishable by about 5 years in jail.

Btw, I'm pretty sure you didn't work under the table. Damn, my back hurts just thinking about it. You probably worked in a regular job, but you got paid "under the table". :rofl:
