I am starting to wonder about my K-1 petition. Nebraska has seeminly moved on about a week or 2 past my NOA1 date. Yes, I know, they can do odd things, but I still would like to know if I can do anything.

The 'help' line says they will not investigate your petition until it is 30 days past due. Does that mean 30 days past what my NOA1 states, or the current processing times on their website? Is there any other way to find out if you recieved a name hit, or if there is anything else holding up the petition, such as they lost the thing?

01/31/07 - Mailed AOS/EAD package for Olga and Anya

06/01/07 - Green card arrived in mail

Removing Conditions

03/02/09 - Mailed I-751 package (CSC)

03/06/09 - Check cashed

03/10/09 - Recieved Olga's NOA1

03/28/09 - Olga did biometrics

05/11/09 - Anya recieved NOA1 (took a call to USCIS to take care of it, oddly, they were helpful)

I am with ya! feels like everyone is getting NOA2 but you..... Its getting sooo frustrating checking status everyday....

I also want to know how to figure out if I had a name hit or not....

I also have a question.. if the US fiance was arrested even for a minor thing can that delay the application?

Aug 2001- met in highschool in US

Feb 15 2006- sent I 129

Feb 17 2006- NOA1

Feb 23 2006- *touched*

April 1 2006- still waiting =(

July 10 2006- touched!!

July 11 2006- touched again!!!

July 24 2006- touched (RFE in email)

Aug. 7 2006- RFE in mail

Aug 15 2006- sent back RFE (the wait begins again)

Aug 26 2006- touched (RFE recieved)

Aug 28 2006- APPROVED!!!!!- after 192 days~!

Sep 3 2006- get NOA2 in snail mail

Sep 13 2006-NVC recieves case!!!

Sep 18 2006- NVC sents case to Embassy!!

Sep 21 2006- Embassy recieves!

Sep 27 2006- Embassy send interview packet!!

Nov 9 2006- Medical completed

Nov 20 2006- Interview APPROVED

Nov 22 2006- picking up my VISA

NOV 23 2006- leaving for ATLANTA

I'm sure with all the Immigration talk and reform in the govertment, that is helping SLOW things down in this process. There really is not a set date, when you get it you get it. Your better to email them, if you have questions, then to call them. It's best to only call when you have the NOA 1 and NOA 2, they can give you a more diffrent answer with when and where your case is or to be sent. They seem to blow persons off before the case is sent to the NVC.

The criminal status of the U.S. citizen does not affect your application. They are only concerned about the immigrant.

that's 30 days past the number of days they allow for processing. So if they say it takes 90 days to process they will only investigate after 120 days. Hang in there :)

The criminal status of the U.S. citizen does not affect your application. They are only concerned about the immigrant.

Security checks are also done on the USC petitioner so if there is a name hit due to a prior arrest it will show up and still must be resolved before an approval will be given.

Chuckles,

On what date did the NCS post that it is processing petitions with a Notice Date more recent than yours? Add 30 days to that date, and that's you're overdue date. Unless your case had a 'hit' on the IBIS or some other check, in which situation a case is taken out of the normal flow of processing and no longer has an overdue date. (Thank you, Matt, and I hope I remember correctly.)

Remember that the processing dates tell us when a case has been taken off the shelf and has been given to a case officer (along with a stack of many other cases). The processing dates do not tell us that processing has been completed, or even that processing has begun. Only that someone has to case to process.

I have what many would call "intimate knowledge" of having to experience this "name hit'. Aussiewench is right. A name hit must be investigated. But the issue of it being resolved has no bearing in a legal sense. Even with an active warrant. I am currently being investigated for something in California I had no knowledge of from 13 years ago. I am also a reservist who just had a security clearance given to me by the FBI. The IBIS, which is the primary tool the USCIS uses to check all people who are on the K-1 visa application, is very unreliable. Yet this is what we are stuck with. I did have a lawyer tell me that in no way can this lead to a denial. There is nothing in any regulations that says it would deny you, the USC, the benefit you want for your fiancee. If they take your application and "lose it" you can threaten to sue them for not doing their job. I believe they call it a Mandamnus. I have been waiting 6 month now I have am currently written my congressman. The lawyer's advise was to bother the hell out of the USCIS. Even when they say wait 60 days or 6 months. Be a thorn in their side. A mandamnus case is the last resort kind of thing but it is a tool we can use likened to a nuclear button. I am not going down quietly and neither should any of us who are having to endure this kind of delay. Hang in there
