Have you tried calling and using the RFE trick? You call them and you tell them that you saw online that your case status online dates have changed and you are worried it might be for an RFE so you are calling to inquire about that. I used it last year to find out b/c I saw I had several touches.

Eresh- I pm with Elberth last night and she said yes that had done that twice told her maybe try again but defo on getting help - I will send her the local contact information in her area for political action - they are so outta guidelines and with the help of VJ - I have learned that sometimes the last but sometimes THE BEST RESORT is your senator or congress person. Again we all know its a hit or miss situation but it can not hurt.

I only wish them approvals soon as I do anyone else waiting.

I am going back to China in 3 weeks to see my wife,i been waiting for 7 months now still no NOA2,,,,and i thought our goverment didn't believe in torture? Going back to see her is the only thing keeping me from going nuts now.

We're lucky to be able to travel every 2 months or so and see eachother.

I wish we could use this money for a down payment for a house, but we can always make more money... the time we're wasting not being together will never be recovered.

Elbereth and jonbless - you guys are past your service center dates for processing for I-130. Did you call them?

Elbereth - you are Aug 07 filer at CSC, which has processed I-130 until Sept 5 '07. Did you call CSC?

jonbless - you are Jul 07 filer at VSC, which has processed I-130 until Jul 30 '07. Did you call VSC?

First time he called their system was down

Second time he called he got through the RFE line and some a s s h o l e told him that processing dates are just a directive, that it doesn't mean anything, that each case is a case etc etc the usual bs

Third time he called he spoke to a nice person who told him to hold in line and went searching for where our file was phisically. He said it was already assigned to an adjudicator and that we should be looking for results soon. We got a touch on march 27 and 28. Got our hopes up. That was two weeks ago.

Fourth time he called, on tuesday, their system was down

He is going to try to talk to someone again today

I have exhausted all of the possibilities for help.

My lawyer has given up. Unless I pay her more money on top of the fortune I have payed her already, she will not do anything more. She can go to hell. Excuse me for that but I really can not believe what she has NOT done for me.

I've tried the RFE trick a number of times, but they tell me that I need to wait because they are backed up.

Nothing more than this. No touches received from any of my calls.

(last touches were Feb. 4 and Feb. 10 I believe because I sent a change of address.)

I have sent paperwork to my Senator Hillary Clinton, and they said they will make an inquiry, but they are backed up as well, so this could take some time.

My congressman's office has been the most helpful. He called vermont using the congressional phone line and they told him that in 14 days we would hear something. 14 days past on Monday so he called again to make a expedited request, but they said to wait another 14 days before sending the request.

So..........we wait again, and if by the 21st we have no answer(which I'm pretty sure we won't) they will send an expedited request which he said would put our case in front of others. I don't believe anything anymore, so all I can do is wait like we have been doing for 9 months, and hope that there is some truth in what my congressman's office is saying.

It's hard to believe but things look much more screwed up now than when we went through this a year ago. I really feel for all of you who are still waiting...I keep checking here once in a while hoping to see you all approved. I'll keep you in my prayers.

well, I don't think anything has improved.. I'm giving them a deadline of December 2008 (before I move back to China).. by that time, they SHOULD HAVE approved it.. if not, then probably it will never get done... but at least I will be with my baby.. they can't take that away from me..

On a congressional inquiry, is it not the 72 hour rule on giving a response and I dont mean the typical excuse of that we are backed up? Because if you look, their are applications that have been moved that are after yours.

well, the person I talked with today actually "cared" for me.. yay.. she said she will look into our case, but since I have service requests created recently, she can't do anything for 60 days.. she said both my apps are under someone and that they have a "target date" of end of April (April 20 something) to finish the I-130 and I-129F... hopefully something will get done.. I have no confidence because "service requests" have been created on my case as early as October with nothing to show for it..

Well said gogo! Dec 2008 is my deadline too. I am moving to India after that to be with my wife, if she is not here by then (which means, USCIS must approve much before).

haha, hurryup.. you can tell USCIS to HURRY UP... actually I'll even take the approval by that time.. not the visa.. I hear that after the approval, just 2-3 months until the final visa interview.. I can take 2-3 months.. =) so deadline is for just approval.. I'll take anything right now.. I-130 or I-129F..

here is what my husband was told today

our case was sent back to "records" to be consolidated with the I129F, so it's on a shelf

she gave us one week, maybe two

she said they're working on on the september 9th I130 date

our date is august 9, but she said it's september 19th, we think that because we sent it to NSC and then they transfered it to CSC, that might have caused this difference in dates and thus this extra delay.... one month to transfer... !@#!@#!@#

anyway, i think that excuse she gave kind of makes sense, but it kind of doesnt, becase a LOT of people with dates similar or much later than ours were already approved

lets see what happens in the next couple of weeks

shoot, I have been told a couple of times that the PROCESSING TIMES you see are when they START processing your cases.. I said , "NO WAY, the website said "these cases that have just been COMPLETED".. then the people start getting nasty.. :angry:
