Hi all.

My question is...

Once I receive the NOA2 (which I don't have yet) and my petition get's sent to the NVC, will I be able to relocate to my hubby in his country to wait it out for his interview?

I have read that after an approval, the whole case is out of USCIS's hands.

Any idea's on this is greatly appreciated and I will be doing my own research as well.

You have to attend an interview in your home country.

You run a risk of being refused entry into the US if you come here on a tourist visa.

If I read this right you are asking if you can go to Gambia to wait until your husband has his interview. If thats correct then I would assume that as long as you have the required visas and paperwork to visit the Gambia, you are free to visit there from the US for as long as you are permitted to stay as a tourist.

I am the USC and my husband is the benificiary if that helps.

I couldn't be refused entry because I live in the U.S. and was born here.

And I wouldn't be going on a tourist visa because I from the U.S.

Nothing from the immigration perspective says that you can't do it now as long as you can maintain domicile, fulfill the affidavit of support requirement and respond to any NVC requests.

Also, I have a Gambian visa that is good for a year and can be renewed anytime while I'm there. Also, the way it works there, ....if you have a few dollars, you can get whatever you want. lol.

he he. A lot of countries are like that. In America, money talks. In a lot of third-world countries, money screams, yells, and dance!!! :dance:

Good luck in Gambia. I'm jealous. I wish I could afford to go to Philippines and wait it out.

When your petition goes to the NVC, your husband must declare who will act as his agent. In most cases the USC spouse is named the agent so all forms and fee bills are sent quickly to the USC's address, and also quickly mailed back to the NVC. If you become the agent and live in Gambia, all forms and fee bills will have to be mailed to Gambia and back to the NVC in the USA, which will take a long time and possibly get lost. Bad idea.

You could pick a close US relative to at as agent but if you get any RFEs, then most likely you must get involved to reply to the NVC RFE.

I'd think about this carefully.

oh my godddddd. USCIS is the GESTAPO!!!

They SAY we can travel freely because we are from the U.S., but YEAH RIGHT!!

This REALLY pisses me off! USCIS has found a way to make us all into little "sheeple".

Sorry folks, just missing my husband and can't understand why we all have to go through this madness.

Most petitions can be approved within a few minutes of hopping up onto someone's desk,...yet it takes months and months to even get pulled from "the Box". Yuck.

I'm sorry I didn't read it correctly I thought he was coming here to US.

If you are filing for IR1/CR1 you still have thinks to pay and submit through the NVC so will you have someone in the US to do this for you?

Hi, Leedah! I posted a similar topic maybe a month ago, and I couldn't come up with any good reasons not to go join my husband for a while. A very nice person messaged me that she was in England and did the same thing and recommended to go for it if you have the possibility. I sent my I-130 in January, so I'm nowhere close to getting approved yet, and I have a ticket for Bulgaria leaving on May 14, so all the potential RFEs and NVC craziness will take place from afar.

The issues that came up from my posting were:

  • Proving domicile (since I certainly can't pay rent on an apartment the whole time I'm away). Six weeks before I leave, I changed my address, driver's license, etc, and updated USCIS with my friend's address where we will stay when we first return. All my immigration paperwork will go there [um - *fingers crossed*].

  • Getting all the paperwork, making the payments. FedEx works in Bulgaria, takes about a week for things to get to his village, and two days to get back here. Even 30 FedExes at $30 each is still less than one plane ticket there. I am setting up a Fed Ex account before I leave. Also, assuming the fees don't increase in the next few months, I am going to have the NVC cashier's checks/money orders prepared (as long as they don't expire for 6 months or so - I haven't looked into this yet). Otherwise I would have to send a personal check to my friend with the paperwork, envelopes, whatever, and have her get the money order.

  • Proving income for the I-864 (since surprise, surprise, my great job won't let me take an indefinite months-long leave of absence!) I will have already cleared the poverty threshold with this year's income before I quit the job - and I am a writer so I have lined up some potential freelance contracts as "ongoing employment" - so I am hoping that that will be enough come interview time. BUT I am having my mother fill out all the joint sponsor information as a backup.

So I could be the agent, and have everything sent to my address in San Francisco. Then my friend will scan and e-mail the documents to me (if I don't need the actual document) or send it to me by FedEx, with ~10 days added time for that process. I think with James' shortcuts, though, I can generate a lot of this on my own so we might break even. I am trying to get a handle on exactly what is needed when and have everything with me before I leave. I'm discovering something new every day. I am incredibly grateful for the information on this site!

I *know* there will be complications and delays doing it this way, but I have this opportunity, plus I want to get to know his kids (who are not coming with him), his language, etc. etc.

Plus I can't focus on my work, so I'd probably get fired in the next few months anyway! hahaha

Hopefully this helps anyone who is considering waiting out the visa journey abroad.

October 5 - I-751 sent APPROVED 111 days from NOA-1 date, no interview.
NATURALIZATION - 2012
APPROVED 79 days.
May 9 - Oath ceremony - in Oakland, CA.

March 19 - Sent e-mail Choice of Agent, without scan of DS-3032. Paid AOS fee ($88).
April 1 - Choice of Agent information accepted (10th "working day" to accept).
April 3 - IV invoice appeared. Paid IV fee ($230).
April 11 - Sent IV package and AOS package TOGETHER. Confirmed delivery April 15.

April 26 - Case Complete (10th working day)

May 14 - Interview date assigned (12th working day)

June 5 - Interview in Sofia - VISA GRANTED!!!

June 16 - POE @ SFO. No problems. He's a citizen now!

Oct 4 - US Passport received. (SS card received some time in the summer; had to go to SSA office to obtain)
