Dear all

My wife came successfully on a K1 visa. I sent in her AOS package at the begining of Feb and recieved rejection notice with the entire package two weeks later. The rejection notice were for both I-485 and I-765. The reason being the check amount is incorrect. I had sent in a single check for $1350 which is the correct amount and I assumed the reason for rejection is that I needed to sent seperate checked. I re-sent the package with two seperate checks, $930+$80 for I-485/fingerprint fee and $340 for I-765. I have a return receipt from USPS on Feb 20th, and now it has been more then a month without a NOA. How long does it normally take you guys to get a NOA after summitting your AOS package? I guess i'm just worried since the first NOA rejection came so fast and this one is taking much longer.

The correct amount is $1,010 as the I-765 fee (as well as the I-131 fee) are now included in the I-485 fee

I was recently rejected too (but for a different reason) and it took them 38 days to send the package back....

Unfortunately, I believe the fee for the I-130 is $355 and not $340, so that may explain why you haven't received NOAs.

12/15/2007: Wedding

02/11/2008: AOS/EAD/AP/I-130 package sent

02/12/2008: Package received by USCIS

03/21/2008: Received package back (38 days), rejected due to missing signature on I-130 (darn it!!)

03/21/2008: Sent the package back to USCIS

03/23/2008: Package received and signed for by J Morones

03/27/2008: NOA dates

03/28/2008: Checks cleared!

03/29/2008: Received all 4 NOAs in the mail

03/31/2008: All 4 cases are online

04/02/2008: Biometrics letter (appointment for April 15th, 9am)

04/12/2008: Biometrics completed

06/12/2008: AP and EAD approved!

01/30/2009: Green card approved

02/26/2014: N-400 received by USCIS

03/20/2014: Biometrics appointment

06/10/2014: Initial Interview scheduled (request for re-schedule submitted due to pre-planned international travel)

06/13/2014: New interview letter issued for: 07/21/2014

07/21/2014: Interview completed: recommended for approval

07/24/2014: Received e-mail notification, case status: oath ceremony

You did not need to send the separate check for I-765. The cost is included when filing for I-485. Hopefully they will just disregard the second check and process as normal. :whistle:

Unfortunately, I believe the fee for the I-130 is $355 and not $340, so that may explain why you haven't received NOAs.

The OP is not submitting an I-130 as this is a AOS from K-1

Nevermind my post....just realized you were referring to I-765...which, as already explained, is included in the $1,010 fee for the I-485....sorry for the confusion!

I mailed off our I-751 on February 23rd and it was received at TSC. I have not gotten a NOA yet and my check was cashed already. I tried to find out a reason for the delay of getting a NOA and on their website and on their phone system it says NOA's can take 15 weeks since the fee increase. :( Several others on here are posting that they have not received their NOAs yet too. Good luck.

Did you look on the back of your cancelled check to get the case number? That is really the only important piece of information that the NOA1 provides.

Hopefully they'll just send your $340 check back instead of rejecting the whole thing again. There is no fee for I-765 when filed with an I-485.

Facts are cheap...knowing how to use them is precious...

The fee is $930 + $80 for the I-485, I-765 and I-131 based on the I-485 cost nothing they are a part of the $1010 paid for I-485.

NOTE: Effective July 30, 2007, if you file Form I-485 to adjust your status as a permanent resident, no additional fee is required to also file an application for employment authorization on Form I-765 and/or advance parole on Form I-131. You may file these forms concurrently. If you choose to file the I-765 and/or I-131 separately after the effective date, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence of the filing of an I-485.

I know the directions are dry, but you do need to read them sometimes.

Well at least they gave you back the $340 that you did not need to pay for I-765.

Thank you all so much for your help. I really thought I went over all the details, even bought one of those ' Fiance and marriage visas' book. Can't believe I made this stupid mistake. Well, I did sent in two different checks this time, and one was for $1010 so I hope they will just disregard the other check. I just checked with the bank, and nothing had been cashed. Since I have not recieve the rejection letter, maybe they are processing it. <<fingers crossed>>

My wife and I sent our AOS, EAD and AP and it was received at Chicago lockbox on 3/6. No NOA's or RFE's yet. We have been flying a holding pattern ever since! We sent in one check for the $1010 amount. It looks like a lot of VJ'rs have received the NOA within a week, but some of us have been less fortunate.
