Hello everyone,

I am here to let everyone know that my K3 petition has finally made it to NVC as of today, 3/12/08, and was assigned a case number. :dance::dance::dance::dance: K-3'S ARE STILL ALIVE!!!!

Great. Where's your I-130?

It was sent to the National Records Center to await his arrival in the US and AOS.

Then your written NOA2 would have said something to the effect that your relative was in the US?

This would be back to the standard procedure, post November 2006, if that's the case.

It's interesting that our conversations have swung from last summer and through the fall, how to keep the CR1 case moving, back to panic over keeping the K3 alive. There are some countries where K3 is a real advantage and then there are the families that only filed one I-130 initially and are counting on K4 visas for children to go with the K3 for their parent, who were really hurt by cancelled K3's. It will be interesting to see how all the cancelled cases end up being resolved.

Then your written NOA2 would have said something to the effect that your relative was in the US? (Yes, my NOA2 did say this.) I hope all cancelled K3's will be approved as Divine Mercy's and some others were even after being told the opposite.

07/27/09: Sent in evidence disputing investigation findings

07/30/09: Case processing has resumed

Congratulations Kelly!!! And thank you for posting the information here!! That is just fabulous news (and a big relief) for a lot of us here who want to take the K3 route. However, if I am looking at your timeline right, it took close to two months for your approved petition to get to NVC ?!?! That's a huge disappointment -- I was hoping it would be more like 2-3 weeks. Anyways, congratulations again!!

Thanks Shreyans! The reason it took that long is because some yahoo at USCIS did not separate my K3 petition from the I-130 folder before they sent it to await my husband's arrival in the US. I waited the 2-4 weeks it usually takes to reach the NVC and finally called USCIS to find out what was going on. They ordered my file back from national records center and found out what I said above. They then forwarded it 2 days after receiving it at USCIS and it arrived in 2 weeks from the time they sent it. That was the reason. Good luck in your journey!

Yes, K-3 indeed appears to be alive. I got my NVC case number this morning, and they will send my file to embassy in a day or two. USCIS did not forward my approved I-130 to NVC, so everything appears to be working as it should. It seems that there are at least two other fee-waived K-3 approvals that got through to NVC. So unless someone reports otherwise, it is all looking good!

thanx for doing this.. are you planning to update this list as we see more recent k3 approvals? and the one from VSC, i dont know about that.. i feel it is a typo by the person or a miracle... but i am hoping vsc catches up.. im still waiting.. to see more from VSC... anyways thanx!

Yes, K-3 indeed appears to be alive. I got my NVC case number this morning, and they will send my file to embassy in a day or two. USCIS did not forward my approved I-130 to NVC, so everything appears to be working as it should. It seems that there are at least two other fee-waived K-3 approvals that got through to NVC. K3 does look to be brought back from its coma and in such a way that USCIS is back to the November 2006 announced policy of approving both petitions together, then holding the I-130 and proceeding with the I-129F for K3 visa.

If you want an immigrant visa, don't file an I-129F.

Now, it will be interesting to see if and/or how they resolve the administratively closed I-129Fs, now that they've seen the error of their ways.

Facts are cheap...knowing how to use them is precious...

Wow. People who filed K3 way after me is now going to be together with their spouses sooner than me.

Maybe as a remedy, and for all the added aggravation they caused, they should waive the filing fee for when I lift condition on my spouse?

Based on my timeline and other posts, my guess is that they are currently approving I-130 and I-129F together -- at least at CSC. I think there were at least ten to fifteen simultaneous I-130 & I-129F approvals within the last month.

What is the priority date for K3 visa ......? any one knows or they simply go by I-130 petitions .date..approve both at same time irrespective When I-129 is filed ..............any guess??

If you want an immigrat visa, don't file an I-129F.

Priority date is based on the filing date for the visa you end up applying for. For K3, the applicable priority date is the one shown for the I-129F, not the I-130.

USCIS can not just make changes without creating new policy and announcing them.

USCIS can not just make changes without creating new policy and announcing them.

1. What you've been saying all along is that submitting an I-129F has not delayed the approval of the original I-130 petition. That is wrong. The delay was at least equal to the difference in filing dates.

2. Also, filing an I-129F has killed the option of a timely completed "immigrant" CR1 or IR1 visa process.

3. None of this applies in your own case. Your I-129F was received at the service center after your I-130 was already approved. As such the rules say a K3 case cannot be processed because there is no I-130 pending.
