Greetings Everyone,

I have been with my fiance for about two months now, but the two months were to mainly spent on my treatments for cancer. They have it all cut out but now I must do chemo and also radiation. We are just 4 days away from the end of her 90 days. Does anyone think I have a shot at convincing USCIS if we are a little late getting married?

I would advice you to get married ASAP as long as you are still within 90 days for the KI Fiance visa starting from the date of entry to the U.S for her.

If you have enough money ,you can also go ahead and do the AOS .The most important thing is that you get married within that 90 day window.

I would also suggest you find out if a letter could be written to USCIS informing them of your situation that actually from getting married within the alloted time.You never know, they might extend the KI validity by few more months.

Even with all that you´ve been going through you really should just do a courthouse wedding now, to sign the papers, and then you can plan the AOS and the big wedding if you want. I doubt they´ll exdent the validity of your visa.

I'm doubting that, from what I've heard the 90 days is a pretty strict rule. I would get a marriage license and get a quick courthouse marriage and if you are wanting a big wedding plan one for later (even though you're already legally married).

:thumbs: I agree do the quicky and then plan later for the biggy. I checked the quick route here in Houston $40 for license and $40 for the courthouse marriage.

Yep, I'd get that ceremony performed by whoever is available as soon as possible--maybe a hospital chaplain?

Definitely get married before the 90 days are up. A big wedding can follow any time after when you are feeling better.

The AOS paperwork can be done as soon as it's possible for you, and won't matter if it's a few weeks or more from now.

Hope your health improves and you are feeling better soon.

Oh, man... Such hard moments!

But go and marry her tomorrow, if it's possible! As I know they are actually very strict with this 90 days term! I guess the most important for you guys now is to be together in this difficult recovering period!

Triple check this, but I believe if you marry after the 90-day admission period, you must file I-130 with the AOS packet. This will cost you and additional $190 fee + attachments but at least gives you an option.

Again: I did not do this myself! Please double/triple check this info.!

I agree with others, get married in the courthouse ASAP before 90 days is up! You don't want to complicate things even more.

Well guys, yesterday I got the judge to waive the three day waiting period for marriage license. Now it is just the problem of finding a civil wedding on the weekend. I have a minister who said he will marry us, but I have been told that non-civil marriages do not count with USCIS? I am going to call the local courthouse today to see if we can get a weekend civil marriage.
