Hello everyone,

I appologize if i've made same thread. I've read about the K-1 visa and pregnant case in this forum. However, my case is slightly different from others. Here goes:

My petition has been approved and the Department of State National Visa Center (NVC) has scheduled an interview for my fiancee next week, February 27th, 2008. My fiancee is 9 weeks pregnant. . Questions :

1. Should i contact the USCIS office to inform about this pregnancy ?

2. Will my case be delayed ?

3. Should my fiancee tell her interviewer that she is 9 week pregnant ?

4. Will my child be automatically granted US citizen when he/she is born ?

5. What necessary steps should i follow up during this process ?

I will always welcome all your feedback and instruction. Your help is greatly appreciated. I'm worried that if i'm doing it wrong, i will jeopardize the process of getting my fiance here. Forgot to mention, I am US citizen and my fiancee is Vietnamese citizen. Thanks again.

don't even think about telling them about the pregnancy, because they might ask for DNA test for the baby, meaning u will have to wait till the baby is born, to have the test done, and as u already know, this will take forever. Just pray that everything is done before she has the baby

Wrong. The medical exam results will go to the Consulate. Lying about that will cause problems.

They have been known to ask for DNA evidence at that Consulate. That means waiting for the birth, even though it is a Citizenship issue rather than a Visa Issue. Welcome to HCMC.

The notarized statement from the USC father is an excellent idea and I would get on that post haste. Also, if the fiance is 9 weeks pregnant, there better be documentation that the USC was in Vietnam with her at the time she conceived. If not, a whole other can of worms is opened, so make sure your evidence of that trip is close at hand with the letter.

Thanks for your advice. I'll keep the evidence of the last trip (tickets, photos...) for future reference.

That is the worst advice ever. Yes it is ok to tell about the pregnancy. If you dont, and they see it in the medical results, you can get in trouble for lieing. geez, just adv your fiance it would be a good idea to bring enough evidence to prove you 2 were together during time of conception, and yes a dr can pinpoint time of conception if needed

After reading all of your responses, i am now confused about the whole situation.

One advises that my fiance should cover up her pregnancy so that she could get out of the country fast.

Other instructs to go ahead telling the interviewer about the pregnancy. (I'm leaning to this)

My baby will be born around September 23rd-30th, 2008. I need more info to clear my mind and make solid decision before the interview. Thank you very much!

You can't nor should you cover up the pregnancy. They will get the medical results and know that your fiancee is pregnant. It isn't necessary that she volunteer the information, but covering it up is a bad idea. Could lead to denial over misrepresentation.

Vietnam is a high fraud country, so they may ask you to verify that the child is indeed yours, or if its not, that you know about and are ok with it.

It's hard to say if there is anything you can do to speed things up. You may be through the process quick enough for the child to be born here in the US. Or you could get stuck in AR/AP which many couples going through Vietnam end up in.

You may want to email the consulate/embassy to see if there is anything that they would request with your fiance being pregnant.

This is what I did in my own situation. I went home in April 2007 to see my fiancee and in June it was confirmed that she was two months pregnant. When I filed in October 2007, I included a letter (not notarized) indicating her condition in the I-129F package. In the package, I had evidence of being with her during that period (plane tickets, passport stamps etc).

The baby was born January, and they went to the US embassy in Lagos and reported her birth and also applied for US Passport for her.

I dont see how the pregnancy will slow down the process, so dont worry over that, as long as you have evidence or notorized papers that the baby is yours. It wont speed up the process, but i dont see how it will slow it down either. Im glad you made the decision to have your fiance tell the truth, never never never lie to USCIS or the embassy, they will always find out, when someone tells you to lie or cover something else, always do the opposite. I hate when ppl adv lieing on this forum, i dont understand how that is helping anyone. :no:

Thank you everyone for your quick assistance. :thumbs: Your consultation really eases my worries. I just called my fiancee (it's 3:20 AM in Vietnam now :yes: ) and told her to bring the medical report of her pregnancy to the interview next week. She will get an X-ray within 3 weeks.

In the meantime, any additional information about my case is always needed.

make sure she knows to ask the x-ray techs for a lead apron to cover her abdomen, if they forget to ask her!

THEY CANNOT XRAY HER IF SHE IS PREGNANT My wife was pregnant and they did not xray her or even for AOS they didnt require vaccinations.

Excellent decision. IMO it is never a good choice to tell the untruth.
