you will be eligible to immigrate with your parents at the same time when they are interview provided you gave the right information to the forum..just dont forget to fill up DS-230 form within 1 year of the priority date of your F4 petition becoming current. the rest will be handled by CO..so just chill and wait for the pd to become current for your parents and when the nvc starts sending you the papers for parents, inform them about your cspa case they would make the calculations only when your pd becomes current..

ok guys i have a question. my aunt recently received her visa with her husband and 3 of her children. 1 of her child is 22 yrs of age now. aunt got the visa 7 months ago and now she's here in USA. the embassy, didn't give their son visa coz he's 22?? doesnt he fall under the CSPA.?

my question is what should they do? who should they contact. at the time of the interview, they didn't ask or even mention that our child is 22 or anything and nor the embassy took a note of that. my aunt took the visa and came here and now she's worried about her son.

any suggestions???

IR-1 / CR-1 Visa

2010-04-19: approved online wohoooo

2010-04-24: NOA2 hardcopy received

2010-04-26: gave 2 email addresses and assigned case #

2010-04-27: received/sent ds3032, AOS bill

2010-05-01: IV bill became available online/paid

2010-05-06: sent in DS230 package via express mail 9:07am

2010-05-11: NVC acknowledges the receipt of AOS on 05/05

2010-05-13: operator told me that AOS sent to supervisor for review....

2010-05-14: AVR changes to received the checklist letter response on 5/13

2010-05-23: RFE for original birth cert. (i did sent original).......arghhh

2010-05-24: BC under review by some department

2010-06-02: sent in original BC again and previous BC is still under review

2010-06-10: NVC recognizes BC into their system

2010-06-21: SIF!!!!!omggggg soo happy 57 days in NVC process

2010-06-28: interview on Aug. 19, 8am.

2010-08-19: interview went fine but he's put into AP :(

2011-01-09: almost 5 months in AP "still pending"

2011-02-06: 5 and half months and still counting......when is this torture going to end....

2011-02-20: 6 months still no answer..........

2011-03-08: more than 200 days passed in AP..................(

2011-03-24: visa has been issued today. hurayyyyyyyyyy finally wait is overrrr.

i am sorry for giving you this info that CSPA won't apply to you coz when the priority date becomes current you will be able to deduct around 9 months from your age and that would be your CSPA age for immigration purpose...and that would be more then 21 years so it won't help you...your petition would be transferred to f2b

thank for your reply the_nesh316. my mistake im just turning 22 on October. i used the CSPA calculator and it turns out that my CSPA age is 20 years, 11 months and 15 days. does this mean that CSPA apply to me? Cause i just barely made it. im really confuse.

my bad...you just made it..now the only thing you gotta do is to fill up ds230 within 1 year after the priority date becomes current. if you haven't been contacted by the nvc yet,inform your mom to contct them and tell them about your situation..or else contact your local u.s embassy directly and they would advise you on what you should do..hope this helps..

My knowledge about CSPA finally culminated in a successful application of CSPA to my sister's family. Her son just got visa under CSPA, despite being over 25 on date of visa issuance, because his CSPA age is just over 20. This is a second successful application of CSPA in two families in 2 weeks period.

as you have mention here that your's sister son got visa under CSPA . so I want to know that how to apply for this CSPA and through whom I can apply ?

Pls guide me for CSPA procedure/ time for this procedure / expenses ?

hey guys i went with my parents for the interview and guess wat?? they asked me to get my medicals done and get back to embassy any working day at 7.30am in the morning after paying the vfs courier fee and i also need to fill in ds230 and all necessary documents and take them with me but there is a little problem...

my sister who is in the USA right now for her student visa. the CO asked my dad to call her to india and also asked to pay the VISA FEE, get MEDICALS done and collect PASSPORT POLICE CERTIFICATE,BIRTH CERTI..she is having a legal student visa status but i am tensed coz i think that the embassy is framing here to deny her entry to u.s.a.. when we filled the student visa application for her,there was a question in that which said "has a petition been kept on your behalf?" to which we replied NO because technically the petition is not on her behalf coz my aunt did petition my mom and not my sister ..so the petition is not on her behalf.

my mom and dad were done with the interview on 18th,oath taken,ds230-part 2 signed and the CO mentioned on 221g letter that ME & SISTER NEEDS TO ATTEND THE INTERVIEW AND GET BIOMETRICS DONE ANYDAY..and that we need to take the passport for our parents for stamping the visa on the day we appear for the interview because parents visa wasnt stamped on the day of interview...

now my sister is coming back to india and she has a legal student visa status with no crime and no fraud...would have any impact on the visa??as far as my case is concerned i am done with the visa thing...

please someone help me

and my parents are in process of getting their green cards through my grandmother

can i still benefit from my parents' green card?? or i have to file another form after my parents receives green card?

Hi everybody,

This site has been remarkably helpful and insightful. Here's a background of my parents and brother's petition. I am the designated agent of my mom who is the primary beneficiary of her brother's F4 petition. I am here in the US and I have been a USC since 2008. We are pursuing my mom's petition because of the fact that I think it will benefit my youngest brother. Her PD is April 1, 1988. My brother's DOB is March 6, 1987. According to my uncle(the petitioner) that they have not received any other correspondence from NVC since he filed the petition 22 years ago. Finally Feb. 4,2010 I got an e-mail from NVC that they have the petition and they also attached the IV and AOS bills. I have paid everything and I am about to submit the DS 230 and AOS once I get hold of my uncle's birth certificate. My family is in the Philippines. I e-mailed the NVC last week Jul. 24th to ask about the applicability of CSPA to my brother and they replied 3 days later saying that it is under review but there is no timeline for this. I am getting anxious about the fact that they said there is no timeline for this, do I need to be worried? I tried the CSPA calculator from this site basing from all the dates that I have and it said he is qualified, their PD is current already. So my question is, when they say there is no timeline, does that mean it might take a 6months to 1 year? What course of action do you think I need to do at this point? Thanks for reading and I hope I get a reply soon.

Hey Guys im new here, i'm just wondering if my visa application will be approve eventhough i already turn 21 last July 5 of this year, though the immigration officer back then in the NVC told me that im covered by the CSPA Act and i dont have to worry about my aging out issue.. do i have to still worry about being denied or not?
