my fiance came here on a k1 visa and we are about to get marry. then we are going to apply for her SS card. next in line is AOS. to save money and we are not hurting financially, does my fiance must have a EAD? if not, will that hurt processing the AOS? and 1 more question when i do claim my wife on my tax and how? sorry for the crazy questions.

I'm sure someone will correct me if I'm wrong, but I don't believe she HAS to file for the EAD. She only needs to file for the EAD if she wants to work in this country. If she intends to be a housewife, there's no reason to file for the EAD. When you file for AOS and she recieves her greencard, she will be legally allowed to work if she so chooses.

6/19/2002- Met Online

11/10/2002- Met in person for the first time at Buffalo International Airport we spend a blissful but all too short week together.

2/23/03- David proposes on the beach in Melbourne Florida at sunrise during his second visit.

9/26/03- After much talk with USCIS we decide to go ahead and get married during David's third visit, with David planning on returning to Ireland the following week.

9/30/03- Phone USCIS to ask questions on filling out paper work and USCIS officer informs us that if David is already here he doesn't need to leave. After numerous calls to the Irish Embassy and two more calls to USCIS to confirm, we decide he will stay.

12/02/03- Petition for AOS recieved

10/8/04- EAD FINALLY arrives

11/10/2004- Our Son Colin Michael Kieran born two years to the minute after our first face to face meeting!

1/26/06- Recieved interview appointment letter.

3/09/06- AOS approved! David is a permanent resident with stamp in passport.

4/4/06- Green card arrives. We are now free to travel back to Ireland so David can see his family for the first time in more than two years.

In some states, she's is required to have work authorization to be able to get the driver's license. So, if she applies with a K1, they may issue the DL only for the duration printed on the I-94. I've heard of that happening.

AOS now gets processed pretty fast -- I've seen a lot of cases where EAD takes 3 months, and AOS takes 5 months. So you don't get much "out" of an EAD.

Still, if in your area of the country AOS takes typically longer than that, you may benefit from having an EAD. You need the DL, she changes her mind about working, etc...

09-02-2005 Applications for AOS, EAD, and AP received by MSC

10-21-2005 AOS fingerprint notice for 12-08-2005

11-07-2005 AP approved

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

It took about 5 months to get Claudeth's GC so the EAD really wasn't necessary for us

We have hit a roadblock on EAD. We asked, of ourselves the same questions.

Six months down the road, with no Drivers liscense, no social security and no valid identification to be in America we are a little more humble. If you are " kept " woman, or man then you have no need for the EAD. If not then you are screwed. There is more to this than working.It is about driving, cashing checks, and being a generaL AMERICAN.

09 October 4th application package sent. This time they said the app signature page was a copy

10 Oct Sent package again 4th time.

25 Oct Received another NOA for Wife with $625 for the amount with one year extension

30 Oct 2008 Still nothing for step daughter. Checks still haven't cleared the bank

24 November Checks finally cleared the bank

February biometrics for wife Nothing for daughter.

It really depends on if you can afford to file for the EAD on top of everything else, and what state you live in. David was able to get a DL WITHOUT an EAD. I guess it's just like everything else, a personal decision that no one should be pressured into making one way or the other.

You can file a joint income tax after you get married. If she doesn't have SSN yet she can apply an ITIN (form W-7) with a certified copy of her passport at the IRS. No fee!

The EAD is optional... I got one even though I had no intention of working, because it's a valid US photo ID and you can use it to prove you're legal and to open bank accounts and get a driver's licence etc. All the things that everyone who was born here takes for granted! Also, it depends on where you live... we live in a 'slow' processing area so we expected my greencard to take about two years to come up, and that's much too long to go without ID.

You don't have to. You can wait for the GC but make sure you do apply for a social security number
