Hello all,

I'm long time lurker here, but have never posted...or never thought I had a reason to post until now. But first, just a little background info.

My wife and I have our GC AOS interview next week here in Denver. After 4 years of knowing each other, Natalie arrived to me last May on a K-1 and we were married in the presence of my family and friends last June. Everything is great on the homefront, and we're continuing to treat everyday like we're still on honeymoon :D

We sent in her AOS application last August, along with my affadavit of support, and of course ever since its been a waiting game and as all of you know. Everything was going smoothly until about 2 weeks ago...

I got called into my supervisor's office and was told that the company was downsizing and they laid me off. Several of my co-workers also lost their jobs.

Now, the question is this...how does this affect how we go into our interview next week? Do I just come right out and tell the IO the situation? Or do I just wait and see if they ask for any recent paystubs or the usual financial info? All of our affidavit information from last year is correct and I made way more than the poverty test requires. I also have our joint tax filing for 2007 that has our income. In addition I have paystubs up through end of January until I was laid off. I am obviously trying to find a job as quickly as I can, but what are my options here if the IO has questions about my ability to support my wife. I don't want to lose the game and have them deny her petition when we're on the 1 yard line and about to score the touchdown.

I wouldn't disclose anything until asked.

Assuming you will be asked, here are a couple of options..

1. Can you talk to your supervisor to extend the date of your layoff from end of Jan to say end of next week?

2. Does your spouse work? you can use that as evidence of you not having to support but you are still liable to have the

ability to support.

3. Read the I-864, there is a section[ Sec 29. Total Value of Assets] where-in you can use your assets(instead of your

income) to prove you can support your spouse. I would do another I-864 and keep that handy just in case..

Anyone else offering other suggestions?

hi sorry about your job, my advice to this is dont provide any information that has not been askd for,

if the question comes up on what you do ,

show the documents you have ,but be honest and if you have some savings you could say you are able to suport her with the savings you have ( show prove of savings ),

and that you already send your resumee to some employers awaiting for response ,

maybe someone can give better advice good luck

Yea I would hold off on telling them anything unless they ask. On the bright side, you have paystubs thru January and your 2007 W2. The only thing you dont have that they may ask for is a letter from your employer. My IO asked for either paystubs or a letter.

Perhaps since by the time of your interview you'll only be missing 1 paycheck, it wont be that noticeable. At the same time, I agree that you should show evidence of a savings account if you have one. Good luck.

My heart and prayers go out to you.The exact situation has just happenened to me.April 1,2008 upon my return from the Philippines my manager called me into his office and said they were eliminateing my position and I was no longer needed.Up to that point I had good tax returns with ample money to qualify and then this happens.I have not received the NOA2 yet so this does give me time to come up with a plan.My age is a problem on getting another job that would pay as good and the closer we get to the end of tax year the worse things will look.I have 2005 and 2006 of good income and I made good money up to this point.I dont know whether to tell them that I am laid off or not so here is what I am doing.If you read the section in the I864 that says you can qualify with assests.I am having my classic car appraised.my house appraised,several pieces of property appraised, and I also own a truck and another car.I will be able to claim one of them as a asset,but not the one you drive on a regular basis.I first checked my poverty guideline which was $17,500.00 per year so I would have to equal that amount in assets for five years.Can anyone else explain this better than me or give advice?Good luck.
