Unfortunately, as a K3, your wife will not be able to apply for and get an SSN. She will need an EAD card or a green card in order to get an SSN.

08/17/08: Mailed N400 to TSC

Correct SSA will only issue SSN to those who are work authorized, K-3 is not. You need to wait until having EAD card or Green-card in order to apply for SSN.

Timeline

You may want to double-check on the SSN requirement for the Driver's License. Washington state says that they require a SSN or:

"If you haven’t been issued a Social Security number, you may sign a declaration form when you visit the driver licensing office."

You'll still need some proof of residency, but the visa and some joint utility bill or copy of a lease should be enough. I suspect all states have the same exception.

Your I-94 form is extremely important - it is what shows that you entered the country LEGALLY. Must always keep it with you. You will have to show it for different things as you apply for them until she gets her green card and then that can be used to show she is legal. As of now, she has to apply for her social security card - you should get it in two weeks. You can go to any social security office to do that. Once you have that, you can go on with other things - like the AOS. Of course I haven't done any of this yet but I know from reading on VJ.

Passport and declaration of SSN never issued, got my wife her learner permit in Washington. You'll find this true in many states but you might have to dig for the option.

Your I-94 form is extremely important - it is what shows that you entered the country LEGALLY. Must always keep it with you. You will have to show it for different things as you apply for them until she gets her green card and then that can be used to show she is legal. As of now, she has to apply for her social security card - you should get it in two weeks. You can go to any social security office to do that. Once you have that, you can go on with other things - like the AOS. Of course I haven't done any of this yet but I know from reading on VJ.

The information regarding the SSN you are giving applies to K-1 only. The OP is K-3 and cannot apply for SSN without EAD or GC.

Well i called Social Security today and after 20 minutes of trying to figure out how to speak to a human, i finally got my answers: We can only get an SSN if Work Authorization, even for temporary, was given at POE, which it wasn’t. I know many of you have reiterate the same thing in your response but I just wanted to be sure.

I wanted the SSN# for my wife so that she can get a driver's permit, get started in building credit, etc…TO WORK was not the primary objective. I guess we'll have to start the second phase now. I wasn’t planning on applying for EAD since work authorization is given ultimately when you get the green card (correct me on this if I'm wrong, please) but I may have think this idea over.

EAD is pretty much guaranteed to be available within 90 days of filing but green card approvals can get hung up for a long time. Since there's no fee for EAD, I'd definitely file the application for it as insurance. With EAD, she can get an SSN and all that does for you, whether the green card comes fast or slow.

Facts are cheap...knowing how to use them is precious...

Right. You said you would wait for the green card. You get the green card as a result of filing the I-485 so I concluded you'd file them together.

If you'll be filing your joint taxes soon, your wife will need to be issued an ITIN, she may be able to use that to get a driver's license. Some states allow it, some do not, so check the DMV website for your state.

The best thing to do is to apply for AOS right away, that way you'll get all the documentation needed for ssn and driver's license. in the meantime you can add your wife to bank account, make a join statement, add her to your credit card she'll get one on her name. all of thatm combine over a period of time will start to build her credit. within a year my wife was already over 700 based on those things i did when she moved here, next thing you know you'll start to get all of those junk mail for credit card offers.
