Timeline

Hello everyone! Well, things are going great here...and wedding plans are coming along. Only problem is worrying about the Adjustment of Status.

I've been reading over the guidelines and what to include in the packet that we will be mailing to the Chicago Lockbox. Pete entered the United States on November 21, 2007. We have until February 19th to get married (the wedding is scheduled for February 16th--a Saturday).

According to the guidelines, we must show accounts in our name jointly, etc... What I don't understand is...are they going to want to see the name change-- I can add him to my bank account, rental agreement, and other accounts now I suppose. I was just waiting til we got married, and I changed my name as well. Obviously we have to wait til we get the marriage license back/photos developed even to send anything off. Pete is worried that INS will show up here to haul him away while we are waiting...lol. For some reassurance on his part, could anyone possibly give us the timeline to keep him legal...I mean do we have to have the paperwork filed BEFORE the 19th???? And what exactly would be his status (according to the AOS papers, we have to list what his status would be--how would I find that out???)

21 Nov. 2007-- Pete arrives in the United States (together at last!!)

27 Dec. 2007--Our 3 year anniversary of being engaged

16 Feb. 2008--We were married!!

You must be reading the Removal of conditions Guide for (I-751) not the Adjustment of status Guide.

You do not need to show marital evidence other than a copy of marriage certificate when filing I-485 for AOS.

I don't think you have to worry about joint bank accounts, etc when you send your AOS (I-485, I-864, G325 A, I 131 and I765) . These are the forms you have to send with all the supporting evidence. The joint accounts, joint insurance, lease and utilities in both names, photos together, etc are required at the time of interview. i hope I am correct, please someone correct me if I am wrong

May be needed at AOS interview, and used much later when removing conditions on the 2 year green-card.

For the AOS, you just need to show you got married and maybe some minor evidence. Like Yu said, MAYBE at the interview and most certainly for removal of conditions.

For us, at AOS, he needed his SSN to get on almost anything jointly. Missouri gave me all kinds of problems with that. No AOS, no SSN for us. So, he was on nothing by that time. We sailed through without any of it and without an interview. For removal of conditions later this fall, I am going to bury them in proof paperwork!!!!!

The one condition of the K1 visa is that you get married before 90 days of entering the country, you are doing that so you are OK. It is good to file for AOS as soon as possible after the marriage, but there is no time limit for it. Some people have waited many months to file for AOS! During that time, they are legal so no worry. After filing for AOS, the status is "AOS pending" and one can legally stay in the country until the AOS case is decided. :yes:

they need to received the papers on the 90 days so that your man will not be worried of everything..

There is no law that says you have to file within the 90 days. As long as they've married within 90 days, they are good.

Thank you everyone for your responses. I must have been looking at the wrong guide :blush: I will definitely have a look at the other one. Pete has in the back of his mind that INS will show up one day when I'm at work...and deport him....lol I said he's watched too many movies.
