up to 16 weeks of wait time for NOA1??

hi, all:

Fiona and I submitted her Adjustment of Status form on December 26th 2007. it's been almost 3 weeks and we haven't received any notification yet. our check hasn't been cleared yet either.

today we went to our DMV trying to apply for her driver's license. we were rejected because our DMV now requires NOV1 number. i guess that's because they need to know she really do have legal status in the States...

anyways, so i called USCIS today and heard message saying it now is going to take up to 16 weeks (up from 4 weeks) for any notification to be sent. this is due to heavy increased volume of applications before the fee increase.

4 months is a little bit too long to wait for a notification; 4 months is a bit too longer for Fiona to start practicing driving. isn't this ridiculous??

has anyone else got the same message? i read the December filer thread, it seems that they've got theirs pretty quick. all within the month.

any ideas what's going on?

Hi, as you can see from my signature, I waited more than one month for my NOA1. As both of you seem to be, I was also very concerned about the estimated time they give for the receipt. I called several times uscis, but to no good. Eventually, it arrived though, in less than the 16 weeks which they claim.

So, try to keep your spirits up and, while not hoping too receive it tomorrow, try not to despair and set your mind on the 16 weeks; most probably that happens very, very rare. Don't forget that on uscis site they promise once more, regardless the delays in deciding over the EADs application. That would hardly be possible if you waited 4 months to get your NOA1 :)

One more word, even though I was so afraid that the delay in NOA1 will cause me delay with the application, so far, so good!

I do hope you'll receive NOA11 soon, very soon, and you get to put your mind at rest and she can start driving! :thumbs:

May 16th - received NOA2 hardcopy

May 25th - first set of documents received home in Bucharest (list of documents to present at the interview) - based on fiance's request to open a provisional file

May 30th - packet arrived at the Embassy, Embassy notifies us about it.

June 21st - interview APPROVED!

June 22nd - VISA

August 17th - arriving in USA, through JFK

Sept 8th - wedding :)

Dec. 18th 2007 - NOA for AOS, EAD, AP

Jan. 08th 2008 - Biometrics

Jan 09th 2008 - Transferred to CSC

Jan 09th 2008 - AP approved, EAD card production ordered

Jan 16th 2008 - AP in mail

Jan 19th 2008 - EAD in mail!!!

Jan 24th 2008 - AOS touch

Feb 05th 2008 - AOS touch

Feb 06th 2008 - AOS touch - RFE sent out

March 7th 2008 - Sent response to RFE (new medical)

March 28th 2008 - CRIS e-mail: CARD PRODUCTION ORDERED

April 4th 2008 - GREEN CARD RECEIVED

ROC

Feb. 5th - package delivered at USCIS Vermont

Feb 11th - check cashed

Feb 13th - NOA 1 received for myself (NOA date: 02/05)

Feb 26th - Biometrics

Feb 28th - touch

March 1st - touch

April 26th - CARD PRODUCTION ORDERED

I would think that the 16 weeks is a worst case scenario... and you'll likely get yours soon!

October 17, 2007 - K1 interview - approved

October 19, 2007 - K1 arrived in mail

October 21, 2007 - US entry

October 23, 2007 - Wedding day

November 27, 2007 - AOS, EAD, AP package sent

December 7, 2007 - Received all 3 NOA's for AOS, AP & EAD

December 10, 2007 - Received letter for biometrics appointment

January 2, 2008 - I-485 transferred to California

January 3, 2008 - Biometrics

January 16, 2008 - RFE for I-485

January 22, 2008 - RFE for I-485 arrived

January 23, 2008 - AP approved

January 25, 2008 - Case status finally updated: AP approved January 23!

January 31, 2008 - EAD card production ordered

February 2, 2008 - AP arrived in mail

February 5, 2008 - Sending a letter/RFE to CSC

February 5, 2008 - EAD card production ordered (again?!)

February 7, 2008 - RFE/letter arrived at CSC

February 7, 2008 - EAD approval sent

February 9, 2008 - EAD card received, dated January 23rd!

February 25, 2008 - CSC finally acknowledges receiving RFE

February 27, 2008 - I-485 APPROVED!

February 27, 2008 - Online case status: notice mailed welcoming new permanent resident.

March 3, 2008 - Received welcome letter

March 3, 2008 - I-485 approval letter sent

March 6, 2008 - Green card arrived in mail.

At least your state will let you apply for a license if you have the notice. Many states will not accept that. Marlene had to have either an EAD or the permanent resident card. Since we did not apply for EAD, we had to wait until the AOS was complete and she had the card. Marlene arrived in Dec 2005 and started Drivers training in August 2006.

Oh my goodness! Reading from this thread and also learning from the 1-800 message - looks like I will not be able to drive for months! When I arrived in October, I was able to renew my old DL with expiration based on my I-94 expiration (I had old DL as I've been worked in the US for a few times). After our wedding in December, went to DMV to have it extended informing them we already got married and that waiting for our AOS application receipt. DMV said that they could only use an INS/USCIS document as basis for my DL extension. This sounds ridiculous now since until we receive the NOA (which is possibly more than a month) then that means I would be stucked in the house while my husband is at work the whole day. What a deprivation! I could do a lot if I can drive on my own and not just waiting for my husband to come home after whole day of work for me to go on my errands. I wish USCIS sees this as a big process hole and they do something ASAP.

update: i received my NOA1s (three of them) at the end of Jan. so it took us a little bit more than a month. i don't know why the USCIS phone guy would just scare me like that....

one other strange thing though, none of the application numbers (shown on NOA) is in their system yet. it's been 2 months. i know this is because i tried to add them to my "watch list" on USCIS, but their system told me the numbers couldn't be found. i also tried to call USCIS again on this particular issue. their agents couldn't find the numbers either. he told me to wait for another month for the system to be updated.

Ridiculous!

It is true USCIS used to be backlogged in their receiving departments but as of monday 18th, they say they are up to date in receiving paperworks.

Yes I received the same message numerous times and mine was really frustrating because it was on my I-130 and the whole time I am waiting my husband is stuck in Montenegro.
