advance parole - travel document after filing Adjustment of status.

Most aliens need Advance Parole to re-enter the U.S. after traveling abroad who have pending applications for immigration benefits or for changes in nonimmigrant status.

Any adjustment of status applicant who leaves the U.S. without advance parole is automatically considered abandoning his/her application for adjustment of status. Such a person will generally not be allowed back in the U.S. The person would have to do consular processing while remaining out of US. This applies traveling to any place outside US, even going to Canada (even Canadian Niagara Falls) or Mexico or places like Bahamas.

You must apply for advance parole before leaving the US. If you depart from the US or attempt to enter the US before a decision is made on the application, your application will be considered abandoned.

Exceptions:

H, L, V or K3/K4 nonimmigrants:

If you are in one of the following nonimmigrant visa categories, and if you continue to maintain your status, you may travel on a valid visa while I-485 is pending without obtaining advance parole. Upon returning to the US, you must present your valid H, L, K or V nonimmigrant visa and continue to remain eligible for that status.

H-1 (temporary worker) or H-4 (spouse or child of a H-1)

L-1 (intra company transferee) or L-2 (spouse or child of a L-1)

K-3 spouse or K-4 child of a US citizen or

V-2 spouse or V-3 child of a lawful permanent resident

Refugees and Asylees:

If you were admitted as a refugee or granted asylum and are applying for adjustment of status one year after that, you can travel outside the US on valid refugee travel document and don't have to apply for advance parole.

It has been like 2 weeks, but I didn't get any RFE letter. Any way I can verify if the AP I received is valid?

I am experiencing the same thing... Is this the right AP? I got an email earlier, saying as below

Application Type: I131, APPLICATION FOR USCIS TRAVEL DOCUMENT

Current Status: Request for Additional Evidence Sent

On March 4, 2008, we mailed a notice requesting additional evidence or information in this case I131 APPLICATION FOR USCIS TRAVEL DOCUMENT. Please follow the instructions on the notice to submit the requested information. This case will be in suspense until we receive the evidence or the opportunity to submit it expires. Once we receive the requested evidence or information and make a decision on the case, you will be notified by mail. If you move while this case is pending, call US +1 8003755283 Call to update your address.

What should I do????

In a few days you will receive an RFE (Request for Evidence) in the mail. Your application for your Advance Parole document will be on hold until you respond to the RFE by sending USCIS the additional information they are requesting.

3/4/2008: AP touched - request for additional info

3/7/2008: EAD touched - Approved

3/12/2008: Receive EAD

3/15/2008: Receive I-512L x 2 - dated 3/4/2008

7/10/2008: Interview Letter Received

8/20/2008: AOS Interview and GC is approved!

8/27/2008: Receive welcome letter dated 8/21

8/30/2008: Receive my GC!

Of course that you can apply for SSN. you can show your EAD, marriage license and your passport. You'll get your SSN between 10 days more less. Good luck.

HI GUYS! i read some posts about EAS and AOS...and i'm a little confused. i sent my package for AOS on Jan 31st... and by now i received a case nr for i-765 (even a touch on March 19), but nothing about biometrics app. is that "a must"?! can my case be approved without biometrics? should i be worried cause i didn't get any news about that yet?! plz let me know cause i want to get some action:)

No, the cases only are approved with biometrics. I think that it will arrive soon, some people get their biometrics appointment soon and anothers are schedule for a month after. Have you called to USCIS?

Freecake, a similar thing happened to me as well. I received the AP in the mail, but my online case for AP was not updated - it still shows as application received/pending.

My EAD status was updated properly and I did receive that in the mail. Incidentally, both the AP and EAD came on the same day for me.

I knew some people were getting approved quickly... but I'm still shocked by it :D

I guess I am back to the forum after the K1 wait last summer.

I have the inverse situation. We filed late January, receive the 3 NOA1's early Feb and since NOTHING. Only recently I realized that my MSC number was finally responding online.

It says that our AP was approved on March 14 and sent by mail. But we haven't seen anything in the mail!! My wife has her plane ticket for April 4th (going back to Switzerland to prepare the religious wedding there for this summer) and it has been close to 2 weeks that they say the AP has been sent. Just getting a bit nervous.

Also, the AP new is the first and only piece of news we have received about our cases (AP, AOS and EAD). No appointment for the biometrics, no other notice in the mail or online. Should I worry even more??
