Timeline

Ok here goes my story , No one ever told me that it was a "MUST" to aply for SSN before marriage when coming on K1 status ,

I came on the 12th nov with the K1 and since the marriage was close to entry date I figured to file after marriage with married name , so we went to the SSN office today showed them the print out about K1 being able to work without EAD or stamp just using the I 94 , my birth cert , and marriage cert .

the lady was nice but she blew my mind when she said she cant give a SSN since my status is not K1 now , since we got married , we will need a form from U.S stating my current status ( Greencard )

my question is has anyone incounterd a problem like this ?

and do I have to realy file for AOS first and waite for my Greencard now , before I can go back and try file for SSN ? ( I will send the AOS package this week )

as to the AOS I thought they need prove at the interview for bonafide marriage , how can I show prove when I cant aply to be added to official buisiness without a SSN , mostly everything requires SSN to be added as a spouse , any help is apriciated I NEED HELP thank you

Yes you can apply for a SSN but you can't work unless you have some form of work authorization. If you weren't stamped with a work authorization at JFK, you're not allowed to work until you get your EAD (after applying for AOS that is). So I guess you wouldn't really have a use for SSN if you don't have an authorization to work

see thats just it the print out I have from here says we are able to work without EAD or stamp just using the I 94,

but that was not relevent for the lady she told me I,m basicialy out of status with my K1 visa since we are already married the K1 visa is not valid to file for SSN after marriage ,

and I would need the greencard now to be able to get SSN ,

so in my case does it have to be the greencard or can it be the EAD card after I aplied for AOS ?

You know, I am not positive but it would make perfect sense to me if it's EAD. It's the permission to work while the case is pending. It's kinda stupid for them to refuse you your SSN once you get your EAD!

That's not true. K1s are authorized to work for the duration of their I-94. The OP is eligible to get a SSN up until 14 days before her I-94 expires. An EAD is not necessary for her to get the SSN while her I-94 is still valid.

Lona, go back to the SSA branch and speak to a supervisor. You're allowed to get your SSN regardless of whether you're married or not. You also should be able to apply in your married name if you're using that now. Print the two links out and bring them to the SSA branch with you:

Hi Nini the first link you posted thats the one I brought with me ,

the second link only explains name change when you already got a SSN , ( I dont have one yet , this was supose to be my first card ) does that link aply to me ?? or am I better of just waiting for few month till I get the proper documents and prove them people I am legal status ?

The second link will help if you're trying to apply in your married name. They'll have you in the system under your maiden name and you might get some grief from the SSA branch if you're applying in your married name. Your marriage certificate and passport will suffice to prove a legal name change. :)

Your marriage certificate and passport will suffice to prove a legal name change. :)

my god people can be soooo well hmmmmmmm yeah ok , cose I did show my passport with K1 . ( still valide for another 2 month I 94 ) my birth cer , and my marriage cert , and it wasnt good enough

Ladies answer " sorry mam nothing i can do , we need proper documentation of current status " she even gave me a letter stating they couldnt process the application K1 out of status they need a document stating am a resident , grrrrrrrrr this stuff is getting anoying

or you can just apply for a SSN without mentioning the fact you're married...they don't check...present them with a visa and passport and tell them I'm on K-1 and I want a SSN...so you wouldn't have to go through the ###### of trying to fight

hi, i came here in the begining of september.i went to the social security office in mesa arizona to apply for the card.the lady there told gave me the receipt and said i will get it after a week.BUT after waitting almost a month i didnt get anything,i called them they said i have to go back there to apply again,the big problem was that i didnt pay atention that the receit she gave me didnt have a number as the reciept they give has the social security number.so when i went back to the office they told me they no longer have the social security number service and they told me to go to phoenix office .i went there and they give me a nuber but they said they cant send me the card as my I-94 was going to expire after 10 days (it s expired now) .they told me tht they wont give me a card till i bring my work permission EAD.you rmarried now ,so u r no longer k1 ,this is what they told me there ,so when u get ur EAD go to them.good luck

You won't be able to work until you have your EAD but you would not have been able to work beyond the date of your I94, anyway because the temp EAD given at POE expires in 90 days. You will have to wait until AOS is filed and you get EAD.

Lona, regarding needing a SSN for AOS, I believe you're referring to having the non-USC spouse added to things like bank accounts, utility bills, etc. From what I have read here, you can apply for an ITIN, individual taxpayer id number, which functions in the same way as a SSN but is given to non-USCs that don't qualify for a SSN. That should be sufficient. Someone please correct me if I'm wrong.

I'd go to another office Lona and just get a SSN in your maiden name. Your passport, visa, BC, anything that you have does not say you've been married. Get one in your married name...it will match what they have in their system anyway.

Yup..that was exactly my point...As long as she's gonna have a SSN noone is really gonna care if it was issued a week before or a week after

I believe you were mislead. You should be able to apply for an SSN during the validity of the I-94. Go back to the office or try another one.
